There is hereby established within the Township
of Cinnaminson an Open Space Preservation Committee, the purpose of
which shall be to serve as an advisory council to the Township Committee
with regard to issues associated with open space preservation, and
as more fully described below.
A.
The Open Space Preservation Committee shall consist
of seven members appointed by the Township Committee, one of whom
said members shall also be a member of the Township Committee; one
of whom shall be a member of the Township Planning Board; and one
of whom shall be a member of the Historic Preservation Commission;
and one of whom shall be a member of the Parks Commission; and one
of whom shall be a member of Environmental Advisory Board. All members
shall be residents of the municipality, except one member of the Open
Space Preservation Committee shall be permitted to live outside the
boundaries of the Township of Cinnaminson.

B.
The terms of office of the members of the Open Space
Preservation Committee shall be for one year, and shall expire on
December 31 of the year of appointment. Notwithstanding the foregoing,
to ensure a staggered appointment system, when first appointed, the
terms shall be as follows for seven members: three for one year; two
for two years; two for three years. Should a vacancy arise during
the course of a year, said vacancy shall be filled by the Township
Committee for the unexpired term.
The power of the Open Space Preservation Committee
are as follows:
A.
To conduct research into the use and possible use
of the open land areas of the Township;
B.
To keep an index of all open areas, publicly or privately
owned, in order to obtain information on the proper use of such areas,
and may, from time to time, recommend to the Planning Board and to
the Township Committee, programs for inclusion in the Municipal Master
Plan and the development use of such areas;
C.
Assist the Township Committee in ensuring that the
roster of open space inventory required under Green Acres is current
and complete;
D.
Subject to approval of the Township Committee, to
recommend to the Township Committee, the acquisition of property,
both real and personal, in the name of the Township, by gift, purchase,
grant, bequest, devise or lease;
E.
To make an annual report to the Township Committee
of its activities and recommendations;
F.
To study and make recommendations concerning open
space preservation, water resource and management, soil and landscape
protection; and protection of flora and fauna.
The Open Space Preservation Committee shall
not have authority to expend public funds. As a result, the Open Space
Preservation Committee shall not be considered to be a "public body"
within the meaning of the Open Public Meetings Act (N.J.S.A. 10:4-6
et seq.), and shall therefore be exempt from the provisions of said
statute. Notwithstanding said exemption, however, notice of meetings
of the Open Space Preservation Committee, to be determined on an annual
basis at its reorganization meeting, shall be published in the official
newspapers, and posted on the municipal bulletin board. Moreover,
meetings of the Open Space Preservation Committee shall be open to
the public; however, despite that it is not necessarily governed by
the OPMA, the Open Space Preservation Committee shall have the right
to convene into a "closed session" to discuss issues which it deems
to be privileged, proprietary, or otherwise properly handled in an
executive session.
