The Township Committee of the Township of Cinnaminson deeming it necessary for the proper and efficient conduct of the affairs of the municipality and particularly the administration of certain playgrounds and recreation places hereby creates a Recreation Advisory Board pursuant to the provisions of N.J.S.A. 40A:63-7d to be known as the "Cinnaminson Township Parks and Recreation Advisory Board," hereinafter called the "Board" whose purpose it shall be to advise the Township on recreation policy and to assist the Township in allocating field and court usage. The Board's authority shall begin on January 1, 2007. At the appointment of members to the Recreation Advisory Board, the Cinnaminson Township Board of Recreation Commissioners shall cease to exist and all terms of Recreation Commissioners shall immediately expire.
A. 
Composition of the Board. The Board shall have seven members, each appointed by the Township Committee. Members of the Board to the extent possible shall be residents of the Township of Cinnaminson selected from varied interests and backgrounds, except that at least one member shall be a member of the Township Committee.
B. 
Terms. The Township Committee shall appoint all members who shall each serve for a term of three years beginning on January 1 of the year of appointment, except that, of those first appointed, two shall be appointed for a term of one year; two shall be appointed for a term of two years and two shall be appointed for a term of three years so that no less than two and no more than three terms shall expire in any one year. At least two members of the Recreation Advisory Board, serving in staggered terms, shall be appointed from officers of organized sports groups in the Township to the greatest extent possible. The term of Township Committee member shall coincide with his or her term as a member of the Township Committee. Vacancies for any Board member due to reasons other than expiration of term shall be filled for the balance of the unexpired term.
C. 
Compensation. Board members shall receive no compensation.
The Board shall have the power and duty to:
A. 
Advise the Township Committee with respect to the budget on parks and recreation programs within the Township.
B. 
Develop programs related to parks and recreation for presentation to the Township Committee.
C. 
Provide input and advise to the Superintendent of Parks and Recreation as to the scheduling of the use of playgrounds, parks, fields and other recreation sites.
D. 
Require from all organizations using the parks, playgrounds and recreation facilities within the Township of Cinnaminson on a scheduled basis a certificate of insurance naming the Township as an additional insured as a condition of use of said facilities.
The Board shall have oversight and input on all park, playground and recreational facilities, lighting accompanying same, administration fees, enrollment fees and the like. The Township Committee will, upon advice of the Board, establish the fee rates. The Superintendent of Parks and Recreation, or his designee, has the authority to collect said fees on behalf of the Township and shall immediately pay same over to the Township Treasurer.
A. 
Any person, firm or corporation who, by himself or through agents, servants or employees, violates any of the rules and regulations made pursuant to this chapter shall, upon conviction thereof by a court of competent jurisdiction, be subject to a fine not exceeding $1,250; or imprisonment in the county jail for a term not exceeding 90 days, or a period of community service not exceeding 90 days, in the discretion of the court before whom such conviction shall be obtained.
B. 
Any person who skateboards in or on a park, playground or recreation are which has been designated as a "No Skateboarding" area, shall, upon conviction thereof be sentenced as follows:
(1) 
First offense: a fine of $100 or a period of community service not to exceed 10 days in the discretion of the court.
(2) 
Second offense: a fine of $150 or a period of community service not to exceed 30 days, in the discretion of the court.
(3) 
Third and subsequent offenses: a fine of $200, a term of imprisonment not to exceed 90 days or a period of community service not to exceed 45 days, in the discretion of the court.
