[HISTORY: Adopted by the Township Committee of the Township of Cinnaminson 9-9-1987 by Ord. No. 1987-17 (Sec. 2.124 of the 1995 Code). Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
BUSINESS
All corporations, partnerships, limited partnerships, proprietorships, individuals and/or the directors, shareholders, partners or owners thereof.

It shall be the duty of all businesses within the Township to comply with the registration and annual reporting requirements set forth herein. This provision in no way reduces a business' obligation to apply for, receive or pay for any other licensing provision established by another Township ordinance.
Each and every business required under § 202-2 to comply with this chapter and located within the boundaries of the Township of Cinnaminson is hereby required to register with the Township Zoning Officer or nominee. Said registration shall be on a form prescribed by the Township Zoning Officer and shall include, among other things, the name of the business, its street address, its mailing address, a description of the business, the names and addresses of all officers, directors or owners, the date the business was first established and the area occupied by the business as measured by the square footage of any building or buildings occupied by the business and the lot upon which the building or buildings are located. Said forms shall be filed within 30 days of their availability from the Township Zoning Officer.

A. 
It is unlawful for any owner of a business, owner of a rental unit or units, or the owner of a multifamily home of four or fewer units, one of which is owner occupied, to operate within the Township without first registering its certificate of insurance demonstrating compliance with Section 1 of P.L. 2022, c. 92[2] and paying the registration fee required herein.

B. 
The following entities are required to register their certificate of insurance under this section:
(1) 
Businesses, which shall mean any person intending to sell or dispose of or to offer to sell or dispose of any goods, wares, merchandise or render any services for fees within the Township. This shall include businesses operating on a temporary basis within the Township such as peddlers, solicitors, and transient vendors licensed pursuant to Township Code Chapter 389.
(2) 
Owners of single rental dwelling units, multiple dwelling rental units, and/or multifamily homes that include rental units, even where one unit is owner-occupied.
C. 
The Clerk shall accept, approve, and file registration applications and collect registration fees under this section.
D. 
The registration fees of this chapter shall be as set forth in Chapter 265. Registrations shall expire on December 31 of each year. Renewals must be submitted by December 1 of each year. After the effective date of this section, entities covered under this section shall be required to register by December 1, 2023, and such registration shall be valid for the 2024 calendar year.
E. 
An application for a business insurance registration shall be accompanied by the required fee and shall be made to the Township Clerk upon forms provided by the Clerk. It shall contain the following information:
(1) 
Name and address of the applicant. If the applicant is a corporation, the name and address of its registered agent.
(2) 
The address of the rental dwelling units or business as applicable. If the registration applies to a transient business, a general description of the time frame for operation and area where the business will be operated.
(3) 
A description of the nature of the business and the goods, property, or services to be sold or supplied.
(4) 
A certificate of insurance reflecting the following amounts of insurance in compliance with P.L. 2022, c. 92.
(a) 
Except as provided in Subsection E(4)(b) of this section, the owner of a business or the owner of a rental unit or units shall maintain liability insurance for negligent acts and omissions in an amount of no less than $500,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence.
(b) 
The owner of a multifamily home which is four or fewer units, one of which is owner-occupied, shall maintain liability insurance for negligent acts and omissions in an amount of no less than $300,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence.

Each and every business required under § 202-2 to comply with this chapter and located within the boundaries of the Township of Cinnaminson is hereby required to file an annual report with the Township Zoning Officer each year on or before July 1. Said annual report shall be on a form prescribed by the Township Zoning Officer and shall include, among other things, the same information as required on the initial registration form described in § 202-3 hereof.

In order to cover administrative costs, each initial registration or report shall be accompanied by payment of a fee in the amount as set forth in Chapter 265, Fees. (NOTE: Renewal of the registration or report shall be accompanied by payment of a fee in the amount as set forth in Chapter 265, Fees.) A certificate shall be issued by the Township to each registrant upon receipt of the fee and the registration certificate or annual report, which certificate shall be publicly displayed at the place of business.
Separate licenses shall be issued for each business.
Any business and/or person found to be in violation of any provisions of this chapter shall be fined not less than $100 nor more than $500 for each offense, and the Zoning Officer or his nominee shall enforce the provisions of the order.
