Editor's Note: The preamble to this ordinance, in part, states that it was adopted: "to re-enact Section 2.108 of the 1995 Code as Chapter 225 of the 2007 Code of the Township and to ensure compliance with N.J.S.A. 56:8-136 et seq., which limits registration of home improvement contractors to the state licensing requirements but continues to permit local licensing for contractors who will perform work in commercial and business establishments."
Every general contractor, master carpenter, builder, contractor, subcontractor and other contractors, including but not limited to bricklayers, plasters, stone masons, roofers, cement workers, structural iron workers, pile drivers, sign erectors, tile setters, elevator erectors, well drillers, excavators, grading contractors, heating contractors, air-conditioning contractors, mechanical contractors, wallboard, ceiling, and/or paneling applicators, fence installers and siding installers, and all other New Jersey State-licensed electricians and master plumbers, taking a contract for the erection, alteration, repair, renovation, moving or demolition of any commercial, industrial or business-oriented building or structure or portion thereof shall obtain and pay an annual license fee to the Township Construction Department Permit Office for the use of the Township of Cinnaminson according to the Fee Schedule established in Chapter 265, § 265-24, of this Code.
A. 
All New Jersey-licensed new home builders shall be exempt when building a residence and providing a new home warranty in accordance with the New Home Warranty and Builder's Registration Act (P.L. 1977, c. 467).
B. 
All New Jersey-licensed asbestos removal contractors shall be exempt when only asbestos abatement work is contracted.
C. 
All New Jersey-licensed electrical contractors shall be exempt when performing work regulated by the electrical subcode as outlined in N.J.A.C. 5:23-3.16.
D. 
All New Jersey-licensed plumbing contractors shall be exempt when performing work regulated by the plumbing subcode as outlined in N.J.A.C. 5:23-3.15.
E. 
All painting and wallpaper contractors shall be exempt.
F. 
All landscaping contractors shall be exempt when contracting for installation of a lawn irrigation system.
G. 
All New Jersey-licensed sprinkler contractors shall be exempt when performing work regulated by the fire subcode as outlined by N.J.A.C. 5:74.
H. 
All New Jersey contractors required to be licensed by the state according to the provisions of the Contractor's Registration Act, N.J.S.A. 56:8-136 et seq., where said contractors do not perform any work on commercial, industrial or business-oriented buildings in Cinnaminson Township.

The licenses issued to the contractors enumerated above shall be approved by the Township Committee of the Township of Cinnaminson.

The Construction Official of Cinnaminson Township acting independently from his duties regulated by N.J.A.C. 5:23 shall be appointed as enforcement officer of this chapter and shall report to the Township Committee of the Township of Cinnaminson any violation of this chapter. The enforcement officer shall have authority to issue licenses, pending final approval by the Township Committee of the Township of Cinnaminson.
A. 
Prior to any license being issued, the contractor must provide an original certification of insurance with Cinnaminson Township as the certificate holder. The contractor must carry a minimum liability insurance of $300,000 bodily injury and $100,000 property damage. In addition, the contractor must be insured for products' completion.
B. 
The owner of the commercial, industrial or business-oriented property may waive in writing the insurance requirement to the contractor and a license will be issued limited to, and only to, that contracted job. The contractor will provide a true notarized copy of said waiver.

A. 
Any contractor failing to comply with the provisions of this chapter, failing to maintain an active insurance policy required above, committing serious (i.e., health, safety and welfare) violations of the Uniform Construction Code or being found guilty of crimes pertaining to consumer fraud will automatically have its license suspended by the Township Construction Official, but said contractor may appeal said suspension to the Township Committee by placing its appeal in writing. Following review of each case, the Township Committee, in its discretion, may continue the suspension for a specified length of time; may place the contractor on probation for review at a future meeting; or may revoke the contractor’s license and privilege, as well as its privilege to obtain further licenses within the Township of Cinnaminson.
B. 
Following review, the Township Committee may, in addition to continuing the suspension, or revoking the license, impose and assess a fine upon the contractor, in an amount not to excess $200 for the first offense, $400 for the second offense, and $500 for the third and each further subsequent offense.
A. 
Upon review of this completed application of the insurance certificate, confirmation of references and payment of applicable fees, the enforcement officer shall issue the contractor a license.
B. 
New contractors who have not yet developed a list of three references will be issued a probational license for the first year, if the contractor committed no violation of this chapter within that one-year period, upon renewal the probational status will automatically be removed.
C. 
Any contractor performing contract work for any Township agency or department, including Board of Education, Fire District, Parks Department, Public Works, Library, Sewer Department, may upon written request receive a contractor's license limited to, and only to, that contracted job with all license fees waived.
