The following items shall have the meanings indicated and shall be recognized as forms of solid waste in accordance with this chapter:
BULKY WASTE
Large items of solid waste, such as household appliances, furniture, large auto parts, trees, branches and other oversized items, whose size precludes or complicates handling by normal collection.
COMMERCIAL SOLID WASTE
Solid waste generated by stores, offices and other activities that do not actually turn out a product.
INDUSTRIAL SOLID WASTE
Solid waste that results from industrial processes and manufacturing.
INSTITUTIONAL SOLID WASTE
Solid waste originating from religious, educational, health care and research facilities, from parks, playgrounds and pools and from public buildings, including the Borough buildings and structures.
NONRESIDENTIAL SOLID WASTE
Solid waste from an agricultural, commercial, industrial or institutional agency, or a building or group of buildings consisting of five or more dwellings.
RESIDENTIAL SOLID WASTE
Solid waste that normally originates in a residential environment.
RUBBISH
A general term for solid waste, excluding food waste and ashes taken from residences, commercial establishments and institutions.
The Borough shall collect and dispose of certain curbside rubbish, including bulky waste, residential solid waste, commercial solid waste and institutional solid waste, but excluding industrial solid waste, as defined in this chapter, within the boundaries of the Borough of Collingswood by means of soliciting bids and awarding a contract to a properly qualified private waste hauler.
The Borough Administrator is authorized to prepare specifications in conformance with this chapter and in conformance with statutory and other lawful regulation of solid waste disposal in order to secure the most economical and beneficial methodology of curbside solid waste collection.
A. 
All owners or tenants of any property shall provide suitable watertight receptacles and place therein, from time to time, all swill and slop which shall accumulate on or about their property; and they shall also provide proper receptacles and place therein all residential solid waste and rubbish which shall so accumulate. Said receptacles shall be placed by such owner or tenant on the sidewalks in front of or alongside of their property on the days and times when collections of the same are made.
B. 
Receptacles shall be no larger than three feet by three feet by three feet and shall be watertight and of metal or plastic with a tight-fitting cover and handles. Each container shall have a capacity of not less than 15 gallons or more than 32 gallons and shall not exceed 50 pounds when containing solid waste material. Receptacles that are badly broken or otherwise fail to meet the requirements of this chapter shall be classed as solid waste and disposed of by the contracted private waste hauler. Receptacles must be maintained in a manner that is not a danger to health or safety.
C. 
Watertight plastic disposal bags not less than three mil thick will be accepted as solid waste receptacles. Residential and nonresidential users shall remove any solid waste spilled by animals or vandals as a result of defective or inadequate covers of receptacles.
D. 
When not placed at the curb in accordance with this chapter, all solid waste, bags, or any other receptacles containing solid waste shall not be placed in an area that is visible from the street. Labeled recycling containers, bags, and other receptacles containing solid waste shall be stored in the rear yard or the side yard of residential and commercial properties. For purposes of this chapter, the area(s) comprising the rear yard or the side yard shall be in accordance with § 141-4 of the Borough Code.
No person, storekeeper, merchant or corporation shall encumber or obstruct or permit to be encumbered or obstructed the sidewalk in front of or alongside of his or its residence or place of business with solid waste, including signs, boxes, baskets, barrels, goods, wares or merchandise or any other obstacles, articles or things.
A. 
All residential unit solid waste will be picked up, provided that there is a curbside location to place the same for collection. Solid waste for commercial properties, where there is a curbside location, will be picked up, subject to a limitation of six fifty-pound packages per pickup per property or 300 pounds per pickup per property. Solid waste must be placed for curbside collection in solid waste containers, as defined herein. Solid waste shall be placed at the curb, no less than two feet away from recyclables.
B. 
Solid waste shall be placed for curbside collection after 5:00 p.m. on the night prior to the scheduled pick-up date, or before 6:00 a.m. on the scheduled pickup date.
It shall be unlawful for any ragpicker, scavenger or other person to cut, untie or otherwise unbundle on any street, highway or public place any paper or other rubbish so tied or fastened together and placed for collection by any householder, owner or occupant or tenant on the sidewalk in front of or alongside of the property of such householder, owner, occupant or tenant.
No employee or contractor of the Borough of Collingswood engaged in the collection of solid waste shall, in the course of his employment, negligently or carelessly distribute or cause to be distributed any papers, ashes or other solid waste in or along any of the streets, highways or public places.
It shall be a violation of this chapter for any person to place motor oil in any receptacles used for solid waste, or to otherwise comingle motor oil with solid waste. Residents must bring motor oil in a sealed and labeled container to the Borough Garage, located at 713 North Atlantic Avenue, between 7:00 a.m. and 3:00 p.m., Monday thru Friday.
The Borough Administrator is hereby authorized to promulgate rules and regulations governing curbside rubbish collection and disposal, subject to approval of such rules and regulations by the Borough Commissioners.
Any person or persons, partnership or corporation violating any of the provisions of this chapter shall be subject to a fine not to exceed $1,000, imprisonment in the county jail not to exceed 90 days or a period of community service for not more than 90 days, or any combination thereof, in the discretion of the court. Each day that any of the provisions of this chapter shall be violated shall constitute a separate offense and shall be subject to be punished by fine, imprisonment and/or community service as above provided.
This chapter shall be enforced by the Police Department, Public Works Department, and the Nuisance Officer of the Borough of Collingswood.
