[Adopted 7-27-1970 as Art. 38, Ch. F, of the 1969 Revised Ordinances]
It shall be unlawful to encroach upon or obstruct any public street, alley or sidewalk in the Town of Dover, except while actually engaged in loading or unloading of merchandise or (with the permission of the Building Inspector) during the erection, alteration or repair of a building.
It shall be unlawful to place, throw or deposit any dirt, ashes, rubbish, garbage or refuse of any kind in and upon any street, highway, alley, gutter or sidewalk in the Town of Dover or to permit the drainage of any wastewater, refuse or slops onto any sidewalk or gutter or public alley. The placing of refuse, ashes and garbage for periodic removal by the town, at such times and places and under such conditions and regulations as may be adopted therefor, or sanding of any walks or streets is hereby excepted.[1]

It shall be unlawful to encumber any street, alley, sidewalk or public place in the Town of Dover with any building materials, merchandise or other matters, so as to cause any pedestrian to trip or fall or any vehicle to be upset or damaged in passing; or to allow such substance or material to remain upon said streets, highways or alleyways without express permission of the Police and Building Departments; or to permit any such obstruction to remain after sundown, unless there is kept thereon lighted lanterns or other illumination between sunset and sunrise, in such manner as to warn pedestrians and vehicles.

Any person or corporation violating the provisions of any of the foregoing sections in this article or failing to abate any nuisance or to remove any obstruction when so notified to do so by the Police Department, Street Department or Building Inspector shall be subject to one or more of the following: a fine not exceeding $1,250, a term of imprisonment not exceeding 90 days or a period of community service not exceeding 90 days. Each day of obstruction, or part thereof, shall constitute a separate offense. This article shall be enforced by the Police Department.
