A. 
Any owner of a street, road or right-of-way dedicated to but not accepted by the Township of Evesham shall install and maintain streetlighting on all streets to be dedicated to the Township of Evesham.
B. 
Any owner of a street, road or right-of-way as set forth in § 133-32A shall provide electricity for streetlighting until such time as certificates of occupancy are issued for 50% of the residential units or 50% of the commercial gross floor space in the section (approved by the Planning Board as a discrete section for bonding purposes), within which section the aforesaid street, road or right-of-way is contained; after the aforesaid time has occurred and upon receipt by the Manager of the developer's written request, the Township shall assume the cost of providing electricity.
The Township Manager may, at his discretion, waive the requirements of this article in the event of hardship resulting from low population density along the dedicated street, road or right-of-way.
A. 
The Township Manager may take any action at law or at equity to compel compliance with the provisions of this article.
B. 
Any person failing to comply with the requirements of any provision of this article shall, upon conviction thereof, be punishable as provided in Chapter 1, General Provisions, Article I of this Code.
