Upon the posting of the notice hereinafter described,
no person shall stand, park or cause to be parked any vehicle which
does not have a special vehicle identification, certificate, license
insignia or marker posted thereon or hereinabove defined in any area
or parking place which has been specifically designated as a parking
area or parking place for the vehicles of disabled persons.
Special vehicle identification certificates
shall be posted on the lower righthand corner of the windshield of
the motor vehicle for which it is issued, or metal insignia or marker,
or both, of such design as has been determined by the Director of
Motor Vehicles shall be attached to the license plate or plates of
the motor vehicle for which such identification card and certificate
has been issued.
Notice in the form of a sign described herein
shall be posted at the parking area or parking place so designated
for the parking of vehicles of disabled persons by the owner or occupant,
lessee or licensee; and upon posting, the provisions of this article
shall apply thereto. Upon posting of such sign, the owner or occupant,
lessee or licensee shall notify the Chief of Police who shall cause
said area, so posted, to be inspected by his/her Department to ascertain
that the area is properly posted.

Such notice shall consist of a sign not less
than 12 inches by 18 inches, white background with green lettering
and blue insignia, upon which there shall be written the words “Reserved
Parking” above the handicapped insignia; a ten-inch by twelve-inch
sign, black on white, stating “Penalty - $250 first offense;
Subsequent offenses - $250 minimum and/or up to 90 days community
service; Tow-A-Way Zone” shall be posted below the above sign.
Said notice shall conform to the specifications for handicapped signing
established by the New Jersey Division of Motor Vehicles.
As used in this article, the following terms
shall have the meanings indicated:
DISABLED PERSON
Any person, male or female, who has sustained an amputation
of either or both legs, or of parts of either or both legs, or of
either or both arms, or parts of either or both arms, or who has been
otherwise disabled in any manner rendering it difficult and burdensome
for him/her to walk.
DISABLED PERSONS PARKING AREA
Such geographical area or parking place which has been specifically
designated for the parking of vehicles owned or operated by individuals
hereinabove defined as disabled persons.
SPECIAL VEHICLE CERTIFICATE LICENSE PLATE INSIGNIA OR MARKER
Such identification issued by the Director of the Division
of Motor Vehicles of the State of New Jersey in accordance with N.J.S.A.
39:4-206 which shall be affixed to the vehicle indicating that a special
vehicle identification card has been issued for the motor vehicle
designated therein.
SPECIAL VEHICLE IDENTIFICATION CARD
The identification card issued by the Director of the Division
of Motor Vehicles in accordance with N.J.S.A. 39:4-205, which, among
other things, identifies the disabled person and the vehicle owned
and operated by him/her, stating that he/she is a disabled person
validly qualified to receive such card.
Nothing in this article shall be construed to
apply to the parking or standing of any vehicle upon lands or premises
lying within the bounds of any public street or highway.
The damaging or defacing of such disabled person
signs is hereby prohibited.

Any person who commits a violation of this article
shall, upon conviction thereof, pay a fine of $250 or up to 90 days
imprisonment, for the first offense and, for subsequent offenses,
a fine of at least $250 and up to 90 days' community service on such
terms and in such form as the court shall deem appropriate, or any
combination thereof. In additional thereto, the police may arrange
to have the offending vehicle towed to a place of impoundment, the
cost of towing to be at the expense of the owner of the vehicle.
