Any person desiring to have the Township Council vacate a public right-of-way
shall file an application with the Township Clerk and comply with the following
regulations:
A.
The applicant shall notify all adjacent property owners
of the proposal to vacate the right-of-way and advise them that they will
be assessed taxes on their prorated share of the vacated right-of-way.
B.
The applicant must obtain a written statement from all
adjacent property owners as to whether they consent to the proposed vacation
of the right-of-way.
C.
The applicant shall notify the Planning Board of the
proposed vacation of the right-of-way. Thereafter, the Planning Board shall
have 60 days in which to advise the Township Council of any objections it
has to the proposal. Failure of the Planning Board to transmit a report to
the Township Council within the aforesaid period of time shall be deemed as
a consent to the proposal.
D.
The applicant must notify the Township Water and Sewer
Engineer and the Township Engineer who shall report to the governing body
as to the existence of any utilities within the public right-of-way as well
as any other pertinent information.
E.
The applicant shall contact all utility companies operating
within the township of the proposal to vacate and obtain a written statement
from the utility company regarding their opinion on the proposal. The utility
companies shall include P.S.E.& G., New Jersey Bell and Garden State Cable,
their successors or assigns.
F.
The applicant shall notify the Chief of Police and local
Fire and Emergency Squads who shall, within (60) days, advise the Township
Council of any objections they have to the proposal. Failure of the Chief
of Police or the local Fire and Emergency Squads to transmit a report to the
Township Council within the aforesaid time shall be deemed as a consent to
the proposal.
G.
The applicant shall provide the Township Council a copy
of the Tax Map delineating the public right-of-way proposed to be vacated.
The applicant will be required to reimburse the township for the cost
of the preparation by the Township Attorney of the ordinance vacating the
public right-of-way, the cost of filing and publishing the ordinance and the
cost of the township's professional staff in reviewing the application.
