As used in this chapter, the following terms shall have the meanings
indicated:
Any two or more persons gathered together and acting in a boisterous,
offensive or threatening manner towards each other or others, or committing
an act or acts which are a breach of the peace, or which tend to create a
breach of the peace.
Any house, store or building or any part thereof which is used for
gambling or is frequented by gamblers, prostitutes, vagrants or disorderly
persons or in which the law is habitually violated.
Any house or building or any part thereof in which prostitutes, lewdness
or other immoral or unlawful sexual acts are permitted.
The officer invested with the jurisdiction to bear complaints of
violation of the criminal laws of the state or of the ordinances of the Borough
of Fort Lee, and to either hold the person so charged for action of the Grand
Jury or to hear and determine the complaint and to impose penalties for the
violation of any of the ordinances of the Borough of Fort Lee.
Remaining idle in essentially one location, and shall include the
concepts of spending time idly, loafing or walking about aimlessly, and shall
also include the colloquial expression "hanging around."
Any proceeding before a Judge as defined herein.
Any adult person having care or custody of a minor, whether by reason
of blood relationship, the order of any court or otherwise.
Any place to which the public has access and shall include any street,
highway, road, alley or sidewalk. It shall also include the front or the neighborhood
of any store, shop, restaurant, tavern or other place of business, and public
grounds, areas, parks, as well as parking lots or other vacant private property
not owned by or under the control of the person charged with violating this
subsection, or in the case of a minor, not owned or under the control of his
parent or guardian.
A.
No person shall maintain or aid, assist or abet the maintenance
of a disorderly house.
B.
No person shall maintain or aid, assist or abet the maintenance
of a house of ill fame.
C.
No person shall commit lewd or immoral acts in any house,
building, public or private places.
D.
No person shall utter any loud, profane, indecent, lewd,
abusive or offensive language in any public place or quasi-public place or
in or upon any private property, not his own, within this borough.
E.
Loitering.
(1)
It shall be unlawful for any person to loiter in a public
place in such manner as to:
(a)
Clearly cause an immediate, actual, physical violent
reaction from any person of ordinary sensibilities, which reaction will cause
or create a threat to the peace and good order of the public;
(b)
So disturb a person of ordinary sensibilities as to cause
such person to react immediately in such a way as to threaten by physical
violence the peace and good order of the public;
(c)
Obstruct the free passage of pedestrians or vehicles;
(d)
Obstruct, molest or interfere with any person lawfully in a public place, as defined in § 200-1. This subsection shall include the making of unsolicited remarks of an offensive, disgusting or insulting nature or which are calculated to annoy or disturb a person of ordinary sensibilities so as to cause such person to react immediately in such a way as to threaten by physical violence the peace and good order of the public. No person shall be convicted of loitering in a public place in violation of this subsection unless a police officer at the time determined that such person was causing or was likely to cause any of the conditions enumerated hereinabove and such police officer, at that time, ordered the person to cease the enumerated conduct, which police order the person refused to obey.
(2)
No parent or guardian of a minor under the age of 18
years shall knowingly permit the minor to loiter in violation of this subsection.
(3)
Whenever any minor under the age of 18 years is adjudicated
to be in violation of this section, his parent or guardian shall be notified
of this fact by the Chief of Police or any other person designated by him
to give such notice.
(4)
If at any time within 30 days following the giving of notice as provided in § 200-2E(3), the minor to whom such notice relates again violates this section, it shall be presumed in the absence of evidence to the contrary that the minor did so with the knowledge and permission of his parent or guardian.
(5)
Any person violating any of the provisions of this section
shall, upon conviction, be punished by a fine not exceeding $200 or by imprisonment
not exceeding 30 days, or both, in the discretion of the Court.
F.
No person shall utter any threatening, offensive, profane,
indecent or obscene language or commit any act which tends to endanger the
public peace in any public or quasi-public place or in or upon any private
property, not his own, within this borough.
G.
No person shall interfere with the proceedings of the
Municipal Court, or use any offensive or abusive language to any Judge while
holding any Municipal Court.
H.
No person shall interrupt or disturb any religious service
or any meeting, congregation or assembly.
I.
No person shall engage in a fight or personal encounter
or use or attempt to use, physical violence toward another.
J.
No person shall take part in or aid, abet or assist a
disorderly assemblage in any public or quasi-public place or in or upon any
private property, not his own, within the borough.
K.
No person shall solicit from house to house or any public
street, park or public place the gift of money, clothing or other thing for
his own use.
L.
No person shall conduct, take part in or aid or abet
in a cockfight, dog or unlawful prize fight.
M.
No person shall interfere with, deface or mutilate any
fire alarm box or fire alarm system or part thereof or any apparatus connected
therewith.
N.
No person shall knowingly give, send or cause to be given
or sent a false alarm.
O.
No person shall expectorate upon any sidewalk or upon
the sides, walls, floors or platforms of any building, car, cab, bus or other
public vehicle.
P.
No person, other than the person in charge of the operation
of an elevator, shall handle, operate or manipulate any rope, shifting rod
lever or other apparatus or thing attached to or used to start or stop any
elevator, unless requested by the person in charge of such elevator so to
do.
Q.
No person shall forcibly interfere with any member of
the Police Department or the Fire Department or any officer of the borough
in the performance of his duties, or prevent or attempt to prevent any member
of the Police or the Fire Department or any officer of the municipality from
performing his duty.
R.
No person shall deface, disfigure, mutilate, tarnish,
alter or damage any public property or private property belonging to another.
