The definition and regulatory provisions within
this article shall apply only to the handling of safety film, notwithstanding
any other provisions in this title to the contrary. As used in this
article, unless the context otherwise indicates, the following terms
shall mean and include:
A.
"Safety film" shall mean any film made of a material
which has a safety rating equal to or better than the specifications
of the American Standards Association Method Number P1122, 31-1958,
or the latest revision or modification thereof, but shall not include
magnetic tape used for recording sound or videotape used for recording
pictures or sound or both.
B.
"Film studio" or "shooting stage" shall mean any establishment
or area in a building in which music, speech or other sounds are produced
to be recorded for reproduction on safety film.
C.
"Sound recording studio" shall mean any establishment,
room or area in a building in which music, speech or other sounds
are produced to be recorded for reproduction on safety film.
D.
"Effects and titling studio" shall mean any establishment,
room or area in a building, in which safety film is used for the purpose
of preparing and photographing, for incorporation in any motion picture,
optical effects, titles or still picture inserts.
E.
"Film exchange" or "depot" shall mean any establishment
or area in a building which is used for the handling, storing, inspecting,
projecting, rewinding or repairing of safety film in connection with
the distribution of safety film.
F.
"Laboratory" shall mean any establishment area in
a building which is used for storage, perforating, printing, developing,
washing, fixing, assembling, polishing, finishing, projecting or other
operation connected with the production of pictures or sounds on safety
film.
G.
"Screening room" or "Projection room" shall mean any
establishment or area in a building in which motion pictures, using
safety film, are displayed or exhibited to the trade and for which
no admission fee is charged.
Except as hereinafter provided, it shall be unlawful to use, store, have on hand, process or recover any safety film in any establishment or area or to conduct for commercial purposes a film studio, shooting stage, sound recording studio, effects and titling studio, film exchange, depot, laboratory, screening room or projection room without a permit. The storage and use in a theater or motion-picture theater of a motion-picture film used solely in a projection machine shall be exempt from the provisions of this Article IV.
A.
No permit for the handling, use, storage or recovery
of safety film for commercial purposes shall be issued for any premises
as defined herein in a building which is a frame construction or which
is of other than fireproof construction.
B.
A permit shall not be issued for any premises as defined
herein that is not equipped with an automatic sprinkler system having
at least one source of water supply which may be either gravity tank,
pressure tank or an approved direct connection with a water main;
or where such system is supplied by a house water source and approved
by the Fire Prevention Bureau.
C.
No permit shall be issued for any premises that does
not provide at least one approved two-and-one-half-gallon fire extinguisher
for every 2,500 square feet of such areas.
D.
No permits shall be issued for any premises that do
not provide a central fire alarm system which system has connection
with the Fire Department of the Borough.
E.
No permits for handling, use, storage or recovery
of safety film for any purpose shall be issued for any premises in
a building which is also being used for residential purposes, it being
the intention of this subsection to prohibit the use of any building
wherein safety film is handled, used, stored or recovered for residential
purposes of any kind whatsoever.
Any and all establishments requiring and granted permits under this Article IV shall display a notice announcing that the establishment is a safety film establishment, together with a suitable warning that no inflammable or nitrate film is to be allowed on the premises unless conforming to the provisions of this section and also with a notice prohibiting smoking in all storage and manufacturing areas.
A.
Storage rooms shall not exceed 15,000 square feet
and are to be so marked or identified as storage rooms when used exclusively
and regularly for storage of safety film for commercial purposes.
No film may be kept on the floors of these storage rooms and no film
shall be stored in any cellar or basement unless the cellar or basement
is directly ventilated to the outer air and is provided with a means
of egress directly to the street.
B.
In addition, all storage rooms shall be provided with
the following:
(1)
Adequate means of ventilation, either natural or mechanical.
(2)
Incombustible racks or cabinets for adequate storage
off the floors of film not in transit.
(3)
Aisles for adequate access to all parts of storage
rooms.
(4)
Fire doors and assembly which shall have a minimum
fire rating of one hour.
(5)
Walls which shall be constructed so as to have a minimum
fire rating of one hour.
(7)
Cores, spools or reels on which film is mounted shall
be of a material which has a safety rating equal to or better than
American Standards Method Number P1122, 31-1958, or the latest revision
or modification thereof.
A.
In all workrooms in which safety film is handled,
used, stored, edited, projected, cleaned, polished, buffed, processed,
printed, developed or exposed for commercial purposes, there shall
be no more than 50 pounds of safety film per square foot of workroom
area; no more than 1/3 of which shall be considered in work, and out
of containers. All film in excess of the above quantity shall be kept
in storage rooms. No film may be kept on the floor unless it is in
metal, fiber or cardboard containers.
B.
No workroom shall be located in any cellar or basement
unless such cellar or basement is ventilated to the outer air and
is provided with a means of egress directly to the street.
C.
Workrooms shall be equipped with incombustible racks
or cabinets for adequate storage of film off the floor while not in
transit and not in work.
D.
Not less than 35 square feet of workroom area per
person regularly employed shall be provided in workrooms, and where
there are more than five persons regularly employed, the room must
have two means of exit remote from each other.
E.
Workrooms shall have automatic sprinklers of the type
specified under § 216-23B.
F.
All doors shall be self-closing and, together with
the door assemblies, shall have a minimum fire rating of one hour.
G.
All walls shall be constructed so as to have a minimum
fire rating of one hour.
H.
A film studio or shooting stage which has a working floor area, exclusive of dressing rooms, and administrative or office areas of less than 3,000 square feet shall be considered a workroom, as defined in this Article IV, and shall be subject to the same regulations and restrictions as provided for workrooms. Smoking may be permitted only when called for in stage directions.
All electric lighting and wiring shall be as
prescribed by the applicable provisions of the Electrical Code of
the Borough.
All applications for all permits shall be made to the Fire Prevention Bureau of the Borough setting forth the name and address of the applicant, the full details on the type of work to be conducted on the premises to be licensed, a full and complete description of the buildings to be used and the work to be conducted therein, and the name and address of the person in charge of the premises. The Fire Inspector shall immediately, upon the filing of the application to the Bureau, inspect the premises to be licensed, and if the premises meet with the provisions of this Article IV and all other rules and regulations of the Borough, the permit shall be issued upon payment of the following fees: $1 for every 100 square feet of area per floor or part thereof.
This Article IV shall in no way affect the provisions of the Zoning Ordinance of the Borough.
