A. 
The Governor of the State of New Jersey by Executive Order No. 104 dated February 7, 1981, has declared a state of emergency as a response to unusually dry weather conditions in 1980; and the continued drought emergency presents the eminent threat of a disaster affecting the health, safety and welfare of the residents of this state as well as to the industry located herein and, in order to prevent such harm, immediate action must be taken and, as a result thereof, has issued Executive Order No. 104 dated February 7, 1981.
B. 
The Mayor and Council of the Borough of Fort Lee are desirous of incorporating the Governor of the State of New Jersey's Executive Order No. 104 dated February 7, 1981, into this chapter by reference; and the Mayor and Council of the Borough of Fort Lee, in furtherance of the Governor of the State of New Jersey's Executive Order No. 104 dated February 7, 1981, make all nonpotable water contained in swimming pools, streams, ponds, wells and wherever else located within the Borough of Fort Lee subject to seizure and use by the Fire Department for use in fire-related emergencies. This is to be implemented during a declared water emergency where potable water supplies fall below a ten-day supply.
The Governor of the State of New Jersey's Executive Order No. 104 dated February 7, 1981, is hereby incorporated herein by reference.
All nonpotable water contained in swimming pools, streams, ponds, wells and wherever else located within the borough are subject to seizure and use by the Fire Department for use in fire-related emergencies. This is to be implemented during a declared water emergency where potable water supplies fall below a ten-day supply.
It shall be the duty of every person in the borough and the members of the governing body and of each and every official, agency or employee of the borough to fully cooperate on all matters concerning this emergency, and none of the above mentioned shall in any way interfere with or impede the achievement of the purposes of this chapter.
