It shall be unlawful for any person to engage in the business of selling or preparing for sale live fowl or poultry or slaughter live fowl or poultry in the Borough of Fort Lee, without first having obtained, from the Board of Health of said Borough, a license for any such purpose.
A. 
Application. Before such license is granted, the applicant shall submit to the Board an application therefor, in writing, setting forth thereon the description of the premises intended to be so used, the character of the building wherein the business is contemplated to be conducted and also a description of all buildings, if any, located within a distance of 200 feet of the premises intended to be so used.
B. 
Reasons for denial. A license will be denied if the application therefor, or an independent investigation, reveals that the premises intended to be so used:
(1) 
Is located within a residential district or located within a residential zone, as the same appears on the Zoning Map of the Borough.
(2) 
Is within 200 feet of any church, library, hospital, sanitarium or other public building, as measured from the nearest boundary line of the premises intended to be so used.
(3) 
Is detrimental to the health of the surrounding neighbors.
(4) 
Does not strictly comply with all the requirements of this article and the rules and regulations of the State Board of Health.
(5) 
Will tend to create a nuisance.
A. 
Conformance. Without in anywise intending to limit the generality of the preceding section, all buildings or places in which poultry slaughtering, or the business of selling, or preparing for sale, live fowl or poultry, is conducted, shall, at all times, conform with the following requirements:
(1) 
The business shall be conducted on the ground floor only.
(2) 
The floors thereof shall be paved with material impervious to moisture and shall be properly sloped to a well-trapped outlet having direct connection with the sewer.
(3) 
The walls of every room in which slaughtering is actually carried on shall be covered to a height of at least six feet with smooth moistureproof material and the remainder of the walls and ceilings shall be finished with a smooth hard surface.
(4) 
No building or place operating under any such license, or any part of such building, shall be used for any purpose other than that provided for in said license.
(5) 
Watertight receptacles shall be provided for all refuse and shall be properly covered and the contents thereof removed daily from the premises.
(6) 
All live poultry or fowl shall, at all times, be confined in coops, unless removed for the purpose of slaughter or sale.
(7) 
Every room and every other place used for the purpose of slaughtering live poultry or fowl, or either of them, shall be ventilated directly to the open air and no such ventilation shall in any way enter a ventilating shaft used in connection with residential apartments of any adjoining building.
(8) 
All coops shall be constructed of heavy wire and in conventional trade size. All stands or counters shall, at all times, be built substantially and maintained covered with marble, slate or other material impervious to moisture. The stands, counters and coops shall be raised from the floor in such manner as to permit thorough flushing under the same.
(9) 
The stands and counters for the sale of poultry shall, at all times, be arranged to permit a clear and adequate passageway to the public.
(10) 
A plentiful supply of hot water shall be provided for cleansing purposes.
(11) 
Every such poultry house or poultry slaughterhouse or other place in which the same is sold or prepared for sale shall, at all times, be kept in a sanitary condition.
B. 
Time for selling. All poultry or fowl shall be sold within 24 hours of slaughtering, unless the same shall be adequately refrigerated, in accordance with the provisions of this article applying to the refrigeration of meat.
A. 
Plucking. Plucking shall not be carried on in a room used for slaughtering.
B. 
Sales of unfit or diseased fowl or poultry. No person shall sell, or offer for sale, any fowl or poultry which is diseased or in any manner unfit for human consumption. This shall apply alike to such fowl or poultry, whether alive or slaughtered.
A. 
License required. No person shall keep or maintain any live poultry, pigeons or other fowl, even for noncommercial purposes, without first having obtained a license or permit for that purpose from the Board covering the premises intended to be so used.
B. 
Regulations.
(1) 
All live poultry, pigeons or other fowl shall be confined in coops or runs.
(2) 
All coops and runs shall be located outside of and completely apart from any building used wholly or in part for dwelling purposes, in which people congregate or use as a food or eating establishment.
(3) 
All coops or runs shall be constructed in accordance with the regulations, if any, of the Zoning Ordinance of the Borough of Fort Lee.
(4) 
All coops shall be provided with concrete floors.
(5) 
A sufficient number of roosts, to provide roosting space for each individual specimen of poultry or fowl kept in said coop and a sufficient number of properly placed drop boards beneath each roost, to catch all droppings excreted by the poultry or other fowl while on the roost, shall be provided.
(6) 
All coops and runs and the entire surroundings of all such places shall be kept clean at all times and shall be subject to periodic inspection by the Health Officer of the Borough, or his representative.
(7) 
Coops and runs shall be disinfected or otherwise treated, when so directed by the Board.
(8) 
The floors of all coops shall be kept clean and dry at all times.
(9) 
All of the droppings shall be removed from each coop and buried, removed from the premises, or otherwise disposed of in a manner approved by the Board, at least once each week.
(10) 
All food for immediate consumption shall be placed in suitable feeding troughs or similar containers, and all other food shall be stored in ratproof containers at all times.
C. 
Applicability of this title. The provisions of this article shall not apply to the keeping of live poultry, pigeons or other fowl for sale or for the preparation for sale, but in all those cases the provisions of §§ 14-22 through 14-25 of this article shall apply.
D. 
Prohibitions.
(1) 
No person shall keep any crowing rooster or screaming or chattering fowl.
(2) 
No live poultry or other fowl shall be permitted to fly or run at large.
(3) 
No coop or run shall be located within 30 feet of any dwelling unit, or place where people congregate, or within 200 feet of any food or eating establishment or within eight feet of any property line.
(4) 
No person shall keep more than one individual specimen of poultry or fowl in any coop for each three square feet of usable floor space within said coop.
(5) 
No poultry food shall be scattered about any premises.
(6) 
Pigeons may be flown if properly supervised, but for a period of no longer than one hour per day.
A. 
Slaughtering; license required. No person shall slaughter or engage in the business of slaughtering any live animals within the Borough without first having obtained a license from the Board so to do.
B. 
Exception. This article, however, shall not apply to the slaughtering of poultry or small animals in accordance with the provisions of this article where the same is herein otherwise permitted.
C. 
Keeping of cattle; license required. No person shall have or keep, or allow to be kept, in any building or part thereof or on any land in the Borough, any cattle, without first having obtained, from the Board, a license to do so.
D. 
Inspection. Prior to the granting of any license under Subsection C of this section, the applicant shall cause an inspection of the cattle intended to be so kept, to be made by a practicing veterinarian licensed in the State of New Jersey, designated by the Board, in order to determine whether or not any such cattle are diseased.
E. 
Regulations.
(1) 
Every stable, stable yard or place where cattle is stabled, grazed or kept shall be kept in a clean and wholesome condition.
(2) 
Manure stored temporarily in stable yards or other such place shall be removed at least once each day and disposed of as hereinafter provided.
(3) 
All stable yards shall be drained and kept in a clean, dry condition, and no vegetable or other putrescible matter shall be allowed to remain or decay in said stable or a stable yard.
(4) 
All manure must be kept in a manure pit, which pit shall, at all times, be kept watertight and protected by a suitable cover from sun, rain, snow and all other conditions which tend to produce offensive decomposition.
(5) 
All manure pits shall be regularly emptied, in accordance with the requirements of the Board.
F. 
Prohibitions.
(1) 
No person shall keep cattle in excess of the number specified in the license granted for that purpose.
(2) 
No diseased cattle shall, at any time, be maintained in the Borough.
(3) 
No cattle shall be kept in a place in which the water, ventilation and food are not sufficient and wholesome for the preservation of the health and safe condition of such cattle.
(4) 
No cattle shall be kept in any stable or stable yard while such stable or place is infested with any contagious or infectious disease germs.
(5) 
Manure shall not be allowed to accumulate in stable yards nor in or near the buildings where the cattle are kept.
(6) 
No cattle shall be pastured within 150 feet of any dwelling or adjoining property line or stable within 50 feet of any dwelling or 10 feet of any adjoining property line.
(7) 
No person shall allow any cattle to run at large in the Borough but same shall be confined to the licensed premises.
(8) 
No manure pit shall be located, placed or maintained within eight feet of the nearest adjoining property line or within 50 feet of the nearest dwelling.
(9) 
No manure may be removed or transported on any public place, excepting in a suitable vehicle properly provided with watertight, completely closed tanks or boxes designed to prevent leakage on to the streets or highways within the Borough and designed further to prevent the escape of offensive odors into the atmosphere.
