A surface water management plan shall be approved by the Land Use Board
of this Township prior to preliminary site plan approval, conditional use,
special exception, zoning variance (if required by the Land Use Board), issuance
of building permit for a dwelling or major building only, preliminary subdivision
approval or any other land disturbance activity, as the case may be.
No person shall engage in any land disturbance activity on any property
within the Township without having submitted a surface water runoff management
plan, together with erosion and sediment control plans, to the Land Use Board
and obtaining approval of such plan and a permit or written waiver of necessity
from the Land Use Board. Where a use variance is involved and the Township
Zoning Board of Adjustment is also handling site plan or subdivision applications
in connection with the same application, the Board of Adjustment shall have
jurisdiction under this chapter in the same manner as the Land Use Board.
The Land Use Board may waive the need for a surface water management
plan upon written recommendation from the Township Environmental Commission
certifying that there is no appreciable increase anticipated in the rate or
velocity of runoff based upon plans submitted.
The following are exempt from the provisions of this chapter:
A. Site plans for development where the vegetative cover
of the land will not be disturbed.
B. Outdoor (not undercover) agricultural use of lands when
operated in accordance with accepted farm conservation policies, including
barns, sheds, silos, grain storage, utility, machinery, watering and stock-handling
buildings when accessory to this use.

Minor amendments to a surface water management plan may be approved
by the Township Engineer, who shall notify the Land Use Board of the nature
and reason for the change.
If at any time the Township Engineer finds existing conditions not as
stated in the applicant's approved plan, the Land Use Board or its designated
agent shall order cessation of all work and seek to enjoin the violation or
take such steps looking to the enforcement of the plan as may be lawful.
