GENERAL REFERENCES
Land use and development — See Ch. 90.
Every new structure, excluding additions, which is erected within the Township of Franklin is subject to setback and side yard requirements. In order to monitor the compliance with the applicable side yard and setback requirements, the owner or his designated agents, such as but not limited to the building contractor, subcontractors etc., will be required by the Township of Franklin to submit a certified location drawing prepared by a licensed engineer or surveyor setting forth the location of the installed foundation.
The certification shall be submitted to the Franklin Township Construction Official prior to the owner of the property and/or their designated agents commencing framing of the structure.

A. 
Should any person(s), owner(s), landlord(s) or their agent(s) fail to submit a certified location drawing to the Franklin Township Building Code Official as required by § 53-2, an immediate stop-work order relative to the project will issue and under no circumstances will a certificate of occupancy or a temporary certificate of occupancy issue and/or that person, owner, landlord or their agents shall be subject to a fine of not more than $250.
B. 
If the foundation has been installed prematurely, any person(s), owner(s), landlord(s) or their agent(s) shall be subject to a fine of not more than $250, and the Building Official shall confirm that all side yard and setback requirements have been complied with prior to issuing a certificate of occupancy or a temporary certificate of occupancy.
If the Building Code Official determines that side yard and setbacks have not been complied with, the stop-work order shall not issue nor shall a certificate of occupancy or temporary certificate of occupancy issue, until such time as any and all remedial work necessary in order to comply with the side yard and setback requirements has been undertaken and completed to the satisfaction of the Building Code Official.
