The Garfield Free Public Library of the City of Garfield, by its Board of Trustees, has adopted a resolution participating as a member of the Bergen County Cooperative Library System, hereinafter called "BCCLS."
As used in this chapter, the following terms shall have the meanings indicated:
IDENTIFICATION
A document used by a person to induce the Garfield Free Public Library or BCCLS to lend and transfer custody of materials owned or in the custody of the Garfield Free Public Library or the BCCLS.
PERSON
Includes a natural person, partnership, corporation, estate or trust.
RULES AND REGULATIONS
Those regulations and rules regarding the borrowing or lending of library materials, the period of time for which they are lent and fines, costs and other penalties as set forth in a resolution or resolutions adopted by the Garfield Free Public Library Board of Trustees; it shall further mean such rules and regulations published and available at the Garfield Free Public Library that may from time to time be adopted by the Board of Trustees.
This chapter shall apply to persons who are members of the Garfield Free Public Library and/or who are members of the BCCLS.
No person shall produce false identification or use another's card to induce the Garfield Free Public Library or the BCCLS to lend library material to them.
No person shall willfully or maliciously tear, deface, disfigure, damage or destroy a book, article or material of any kind, or part thereof, which is owned during the custody of the Garfield Free Public Library or BCCLS.
No person shall detain or fail to return any book, article or other material borrowed from the Garfield Free Public Library or BCCLS contrary to the rules and regulations attached hereto and made part hereof as promulgated and published by the Trustees of the Garfield Free Public Library.
The privileges of any person who detains overdue books, articles or other materials from the Garfield Free Public Library or the BCCLS may be suspended until all fines and related costs imposed are paid, by resolution of the Board of Trustees of the Garfield Free Public Library.
Any person who violates any provisions of this article or the rules and regulations as adopted by the Board of Trustees of the Garfield Free Public Library shall be liable to a fine and related costs as established by the rules and regulations which are made part hereof and attached hereto.
The Director of the Garfield Free Public Library or his representative is hereby vested with the authority to prosecute any and all persons who violate the provisions of this article or the rules and regulations of the Garfield Free Public library as adopted by the Board of Trustees. However, no prosecution may commence for at least 90 days from the date of violation.

Any person who violates the provisions of this article or refuses to comply with the rules and regulations of the Board of Trustees of the Garfield Free Public Library shall, upon conviction, be punished by one or more of the following: a fine not exceeding $2,000; imprisonment for a term not exceeding 90 days; and/or a period of community service not exceeding 90 days, in the discretion of the Judge. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such.
