No person shall at any time set or use a trap of any kind designed or
intended to take hold of, capture or kill any bird or animal within the limits
of the City of Garfield, except that the owner or tenant of any property within
the City of Garfield may trap by any means birds or animals within any building
located on the property of which he is the owner or tenant, and, further,
except that on the land and premises of which said person is the owner or
tenant, outside of a building said owner or tenant may trap any bird or animal
by means of a cage-type trap commonly called "cage trap," "cage door trap"
or "live trap" designed to capture animals alive.
The members of the Police Department of the City of Garfield are hereby authorized and directed to confiscate any and all traps in use in violation of the provisions of §
314-1 hereof.

Each and every person, firm or corporation violating any of the provisions
of this chapter shall, upon conviction thereof, be punished by one or more
of the following: a fine not exceeding $2,000; imprisonment for a term not
exceeding 90 days; and/or a period of community service not exceeding 90 days.
