The Municipal Court of the Borough of Garwood heretofore created and established pursuant to law, N.J.S.A. 2A:8-1 et seq., is hereby continued.[1]

The name of the Municipal Court shall be the "Municipal Court of the Borough of Garwood." Said court shall have an official seal which shall bear the impression of the name of the court.
There shall be a Municipal Judge of the said Court who shall be appointed by the Mayor, with the advice and consent of the Council, and who shall serve for a term of three years, and until the Judge's successor is appointed and qualified. The Judge shall have the qualifications required by law. The annual compensation shall be fixed and determined by the Borough Council.
The Municipal Court shall have custody of all files, papers, dockets, books and books of account of the previous recorder's Court.
The office of Municipal Court Administrator is hereby created and established pursuant to law, with all the powers, duties and responsibilities now or hereafter conferred or imposed upon said Administrator by law or by the Rules Governing the Courts of the State of New Jersey. The previously established office of Clerk of the Municipal Court shall be deemed to be continued in the office of Municipal Court Administrator.
A. 
The Municipal Court Administrator shall be appointed by the Mayor, with the advice and consent of the Borough Council, for a term of one year expiring at the end of the calendar year, and until a successor is appointed and qualified.
B. 
The compensation shall be fixed and determined by the Borough Council. Any vacancy occurring in the office of Municipal Court Administrator shall be filled for the balance of the unexpired term.
The Municipal Court Administrator shall serve under the direction and control of the Judge of the Municipal Court and shall be responsible to said Judge for the performance of the duties and responsibilities now or hereafter conferred or imposed by law or by the Rules Governing the Courts of the State of New Jersey, and such duties and responsibilities, not inconsistent with law, which shall be assigned by the Judge of the Municipal Court.

Any person holding office as Administrator of the Municipal Court who has held such office continuously for five years or more and who has become certified during that period shall hold and continue to hold said office during good behavior and shall not be removed therefrom for political or other reasons except for good cause, upon written charges and after a public, fair and impartial hearing.
The office of Deputy Court Administrator/Violations Clerk is hereby created and established pursuant to law.
The Deputy Court Administrator/Violations Clerk shall be charged with the performance and completion of all clerical duties inclusive of typing, dictation, filing, recordkeeping and the like, subject to the direction of the Municipal Court Administrator and Municipal Court Judge and shall perform the duties of the Municipal Court Administrator in the absence of the Municipal Court Administrator, which duties are now or may hereafter be conferred or imposed upon said Deputy Court Administrator by law or by the Rules Governing the Courts of this state.
A. 
The Deputy Court Administrator/Violations Clerk shall be appointed by the Mayor with the advice and consent of Council and shall serve subject to the availability of funds.
B. 
The compensation shall be fixed and determined by the Borough Council. The filling of any vacancy existing in the office of Deputy Court Administrator/Violations Clerk shall be subject to the availability of funds.
