The Mayor and Council finds that it is appropriate to designate
certain residential streets, or portions thereof, as resident preferential
parking zones for residents adjacent thereto, in which zones automobiles
displaying a permit or other authorized indicia may be exempt from
parking prohibitions or restrictions otherwise posted, marked or noticed.
Each resident preferential parking zone herein designated is so determined
upon findings that such zone is required to enhance or protect the
quality of life in the areas of the zone threatened by noise, traffic
hazards, environmental pollution or devaluation of real property resulting
from vehicular traffic, that each such zone is necessary to provide
reasonably available and convenient parking for the benefit of the
adjacent residents and that each proposed zone is desirable to encourage
the use of carpooling and to encourage the use of mass transit.

The findings referred to in §
21-31 are based upon the following criteria established to the satisfaction of the Mayor and Council:
A. That "commuter vehicles," defined as those vehicles operated by persons
whose destinations are to nonresidential areas, or "recreation center
bound vehicles," defined as those vehicles operated by persons whose
destinations are to the Garwood Sports and Recreation Complex, do
or may substantially and regularly interfere with the use of the majority
of available public street parking spaces by adjacent residents.
B. That the interference by the commuter vehicles or recreation center bound vehicles referred to in Subsection
A occurs at regular and significant daily or weekly intervals.
C. That a substantial portion of the residents adjacent to the proposed
zone desire, agree or request establishment of such resident preferential
parking zones.
D. That a shortage of reasonably available and convenient residential-related
parking spaces exists in the area of the proposed zones.
E. That no alternative solution is feasible or practical.

A. Issuance of permits. The Borough Clerk shall issue permits for resident
preferential parking. Applicants for such permits shall be required
to present proof of residency and vehicle ownership on said streets
in the areas designated as resident preferential parking zones.
B. Applications for parking permits under this article
shall be made in writing on forms provided by the Borough Clerk.
C. Duration of permits. Permits issued pursuant to this
section shall remain effective from the date of issuance for as long
as the applicant continues to reside in a qualified dwelling unit
for such permit, or until the resident preferential parking zone for
which such permit was issued is eliminated, whichever period of time
is less. Permits are nontransferable.
D. The permit shall be returned to the Borough Clerk
upon sale, junking or other transfer of a vehicle. Permit holders
shall inform the Borough Clerk when moving within the permit parking
area. Permits shall be surrendered to the Borough Clerk when moving
outside the permit parking area.
E. Two visitor permits shall be issued to each household in the Resident
Preferred Parking Zones for its visitors. Additional visitor permits
shall be issued by the Borough Clerk upon request. Visitor permits
are nontransferable.
F. Conditions of permits. Each permit issued shall be
subject to all the conditions and restrictions set forth in this chapter
and of the resident preferential parking zone for which it was issued,
including conditions and restrictions which may be altered or amended
from time to time. The issuance of such permit shall not be construed
to be a permit for or approval to violate any provision of this chapter
or any other laws or regulations.
G. All resident preferential parking permits shall be
displayed on the driver's side of the rear window of the vehicle in
such a manner as to be clearly visible to an officer enforcing parking
regulations.
H. All visitor permits shall be displayed on the driver's side of the
dashboard of the vehicle in such a manner as to be clearly visible
to an officer enforcing parking regulations.
I. There shall not be any application fee or permit fee to obtain any
permit.
Resident preferential parking zones are hereby established. No vehicle shall be parked or stopped adjacent to any curb in a resident preferential parking zone described in §
21-37 in violation of any posted or noticed prohibition, unless such vehicle shall have prominently displayed, as set forth in this article, a permit indicating an exemption from such restrictions or prohibitions.
Any person violating any provisions of this
article, failing to comply herewith or providing any false information
in conjunction with an application for a parking permit shall be subject
to imprisonment for a term not to exceed 90 days and up to 90 days
of community service and a fine not to exceed $1,500, and shall forfeit
his privilege to hold a parking permit under this article for a period
of one year. In addition, any vehicle parked in violation of this
article may be towed, at the expense of the owner of the vehicle,
at the direction of the Chief of Police or his designee.
