This purpose of this article is to govern extra-duty
employment by members of the Police Department of the Borough of Garwood.
As used in this article, the following terms
shall have the meanings indicated:
EMPLOYMENT
The provisions of a service, whether or not in exchange for
a fee or other service. "Employment" does not include volunteer charity
work.
EXTRA-DUTY EMPLOYMENT
Any employment that is conditioned on the actual or potential
use of law enforcement powers by a police officer. "Extra-duty employment"
shall include, but not be limited to:
A.
Traffic control and pedestrian safety.
C.
Security and protection of life and property.
D.
Routine law enforcement for public authorities.
E.
Plainclothes assignments.
No person, government, profitmaking or not-for-profit
entity shall hire or contract with any police officer of the Borough
of Garwood for any extra-duty employment except in accordance with
this article.

The Borough may choose to utilize a secondary
service to administrate and perform related actions to the off-duty
employment process. These actions include but are not limited to:
communicating with said person or company to schedule off-duty “jobs,"
scheduling the officers for said jobs, invoicing person, or company,
and receiving escrow and/or payments from person or company in a manner
set forth by the secondary service provider. The secondary service
provider may charge an additional fee for services that is above and
in addition to the fee structure stated and shall utilize business
type collection rules as set forth in the contract between the Borough
and the secondary service provider. The secondary service provider
will reimburse the Borough via ACH or other funds transfer methods,
according to the fees set forth below, due to the Borough and officer,
in a timely matter, usually coinciding with payroll periods for “jobs”
that the officers have performed or were scheduled for, in accordance
with the above listed rules of employment between the Borough and
the person(s) or company seeking services.

The Garwood Police Department will determine,
through procedures established by it, which police officer or officers
shall be assigned to the contract for extra-duty employment. The Chief
of Police shall be ineligible for assignment to extra-duty employment,
except in the event that emergency circumstances requiring his assignment
to such extra-duty employment exist. Emergency circumstances requiring
the Chief of Police’s assignment to extra-duty employment shall
be deemed to exist where an extra-duty employment assignment has been
offered to other Police Department officers and is not filled through
the procedure established for filling such assignments by the Police
Department.
The Chief of Police or his designee may determine
that any proposed employment constitutes a threat to the status or
dignity of the police as a professional occupation, in which case
such employment shall be deemed ineligible for a contract with the
Police Department.

The fee for off-duty police services (extra-duty
employment) shall be as follows:
A. Police
officer: $85 per hour.
(1) Extra-duty
employment afforded by another municipality will be paid at that specific
municipality's extra-duty rate.
(2) $100
per hour for an emergency job (those scheduled within three hours
of the start time).
(a) Emergency rate only applies to jobs scheduled with the Borough of
Garwood.
B. Whenever
a police officer is requested for extra-duty employment, there shall
be a minimum charge equal to four hours charged at the applicable
hourly rates hereto established. Any time billed in excess of the
minimum charge of four hours for hours four through eight will also
be for a minimum four-hour block. Any hours over eight shall be in
one-hour increments. The contracting entity must cancel any scheduled
job at least 90 minutes prior to the start of the scheduled job; if
said job is not canceled in accordance with this provision, the entity
will be required to pay the minimum four-hour charge hereto established.
C. Police
vehicle: The fee for the use of an off-duty police vehicle shall be
$200 per day.
D. Administrative
fee: $10 per hour shall be added as a Borough administration fee,
which shall be retained by the Borough.
