The keeping of any table upon which billiards, the game called "pool," or any other similar game, is allowed to be publicly played, shall constitute the keeping of a billiard hall under this article.
No person, persons or corporation shall open or keep any public billiard hall within the limits of the Borough of Garwood unless such person or persons shall have first obtained a license for such purpose.
A. 
The Council may, at its discretion, grant a license to any person or persons to keep a public billiard hall within the limits of the Borough of Garwood for any term not exceeding one year from the date of such license, upon the presentation of a written application therefor, signed by himself or themselves, setting forth the place or premises where they wish to keep their table, and the number and kind of tables, not to exceed two tables per premises, which they propose to use. The fees to be paid for such license shall be $25 per table.
B. 
Before any license so granted shall be delivered to the applicant or applicants for the same, the license fee shall be paid to the Borough Clerk who shall pay the same over to the Treasurer. All licenses granted hereunder shall be signed by the Mayor and Clerk. All nonprofit civic, religious, veterans, or service organizations, associations, societies, or clubs shall be exempt from paying such fee and the license shall state "no fee."
Whenever the Council shall reject or refuse to grant the application of any person for a license, it shall not be lawful for any such person whose application shall have been rejected to apply again for said license at any time within one year thereafter.
A. 
Every person or persons who may be granted a license hereunder may open his or their billiard hall no earlier than 7:00 a.m. and shall close no later than 1:00 a.m. on weekdays and Saturdays, and may open no earlier than 1:00 p.m. and shall close no later than 1:00 a.m. on Sundays. The premises shall be open to view from the public thoroughfare on which it faces.
B. 
In addition to the general penalties provided herein, said license may be suspended or revoked for violations of this article.
