No person shall construct or reconstruct any public sidewalk and/or driveway apron totaling 100 square feet or more in any two-year period without first making, in writing, an application to the Superintendent of Public Works of the Borough for a permit. The permit shall describe the name and address of the property owner, the location of the intended construction or reconstruction, the size and purpose thereof, the time for completion of all work, the person, partnership, or corporation performing the work and the estimated cost thereof. No permit or inspection as provided for herein shall be required if the construction or reconstruction of the sidewalk and/or driveway apron involves less than 100 square feet in total area of construction during any two-year period. Sidewalk and apron shall be constructed in strict accordance with the specifications and drawing entitled "Sidewalk/Apron Detail for the Borough of Garwood," prepared by Donald R. Guarriello, Borough Engineer.[1]

A permit fee of $25 shall be charged for a permit to lay public sidewalks and/or driveway aprons in the Borough for each 100 square feet or part thereof.
An inspection fee of $50 shall be charged in addition to a permit fee for each 100 square feet of sidewalk/apron or part thereof. All inspections shall be undertaken and conducted by the Superintendent of Public Works, Borough of Garwood.
The owner or occupant of premises abutting any concrete sidewalk shall maintain such sidewalk at all times in a good and passable condition at a grade which will prevent water from accumulating thereon and shall maintain the sidewalk so that the joints thereof are even. The surface of all concrete sidewalks shall be kept properly roughened so as not to become smooth or slippery.
All sidewalks and/or driveway aprons constructed or reconstructed in the Borough of Garwood shall be of concrete material only and the materials and workmanship for public sidewalks and/or driveway aprons shall be in accordance with written specifications on file and made part of this chapter in the Office of the Borough Clerk of Garwood, a copy of said specifications to be provided to the applicant at the time the permit is issued.
If any sidewalk and/or driveway apron, as installed hereunder, is not properly installed nor the proper workmanship or materials used as required by the specifications of the Office of the Borough Engineer, such sidewalk and/or driveway apron shall be replaced in order to comply with said specification. Upon failure of the permittee to replace the improperly installed sidewalk within 30 days of citation by the Borough Engineer of the Borough of Garwood, then said permittee shall, upon conviction thereof, be subject to a fine of not more than $1,250, a term of imprisonment not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof. Any person who violates any other provision of §§ 146-30 through 146-35, inclusive, hereof, shall, upon conviction thereof, be subject to a fine of not more than $1,250, a term of imprisonment not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof.
