For the purpose of this chapter, the following terms, phrases, words and their derivations shall have the meanings stated herein unless their use in the text of this chapter clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
ELECTRONIC MESSAGE BOARD
A sign whose alphabetic, graphic or symbolic information content can be changed or altered on a fixed display surface composed of electrically illuminated or mechanically driven changeable segments either by means of preprogramming or by computer-driven electronic impulses owned and operated by the Borough and located on Borough property.

FEED
To give, place, expose, deposit, distribute or scatter any edible material with the intention of feeding, attracting or enticing wildlife. Feeding does not include baiting in the legal taking of fish and/or game.
LANDFILLS
All of such facilities owned and maintained by the Borough.
PERSON
Any individual, corporation, company, partnership, firm, association, or political subdivision of this state subject to municipal jurisdiction.
PUBLIC PARKS
All parks owned by the Borough as designated on the current map of the Borough.
PUBLIC PLACE

A. 
Any public park, playground or public-owned property;
B. 
Any public street, walkway or alley or parking area; or
C. 
Any place or area to which the public or substantial group has access, whether publicly or privately owned, except where the premises are privately owned and the conduct otherwise prohibited by this chapter is at the invitation or with the permission of the owner, lessee or other person exercising control or management of the premises or the business being conducted thereon.
SWIMMING FACILITIES
That portion of the park located on the westerly side of Doremus Avenue and south of Dorchester Place designated as Lot 15 in Block 32 of the current assessment map of the Borough of Glen Rock wherein is maintained the swimming pool and the kiddie pool, together with all appurtenances thereto and equipment thereof, and particularly the fence enclosing the pool and the land and premises within the fence enclosure.
TENNIS COURTS
The fencing and enclosure, as well as the tennis courts confined therein, which are located on lands:
A. 
Owned by the Borough, known as Lot 49 in Block 120 of the current assessment map of the Borough, containing approximately 11.376 acres and located on the south side of Maple Avenue, east of the Erie Railroad right-of-way of the Bergen County Shortcut.
B. 
Owned by the school district, known as Lot 1 in Block 150 of the current assessment map and located at the corner of Radburn Road and Kirkwood Place. The provisions of this section shall be effective as to the school district tennis courts only when such tennis courts are not in active use by or under the control of the school district.
WILDLIFE
All animals that are neither human nor domesticated.

A. 
Use of the municipal facilities as above defined shall be subject to rules and regulations as recommended by the Chairperson of the Division of Parks and Recreation and approved by resolution of the Borough Council.
B. 
Rules and regulations for swimming facilities shall be posted at all times on the bulletin board at the swimming facilities, and a copy shall be filed with the Borough Clerk for public inspection.
C. 
Rules and regulations for the tennis courts shall be posted on the bulletin board in the Municipal Building and made available for the public at the tennis courts.
D. 
Rules and regulations for the public parks shall be posted on the bulletin board in the Municipal Building and made available for public inspection, except that all rules and regulations fixing the hours of opening and closing of any and all public parks shall be prominently displayed at the entrance of the park or parks controlled thereunder.

Fees or charges for the use of the swimming pool or tennis court, participation in Borough programs by bona fide residents of the Borough and their guests, use of the electronic message board or any other municipal facility as defined above shall be as provided in Chapter 101, Fees.
A. 
Swimming facility rules and regulations shall be enforced by the Commissioner of Parks and Recreation, the Pool Director, Director of Recreation and, in their absence, by the person designated as the chief lifeguard. The swimming facilities shall be open on the days and during the hours determined by the Commissioner of Parks and Recreation. No person shall enter upon or use the swimming facilities except upon the days and within the hours that the facilities are open.
B. 
The Commissioner of Parks and Recreation, the Pool Director, Director of Recreation or, in their absence, the chief lifeguard, may close the swimming facilities whenever in the judgment of any of them such action is deemed necessary or desirable for the protection of health of the persons entitled to use the facilities. Such action shall in no way entitle holders of badges to any refund.
C. 
Members of the Police Department of the Borough, the Commissioner of Parks and Recreation, the chief lifeguard and all other lifeguards, when on duty at the swimming facilities, shall have authority to prohibit any action or conduct which they consider to be dangerous, improper or immoral or any act or actions in violation of rules and regulations hereinbefore provided, and they shall have the power of expulsion or suspension of the privileges otherwise granted to the holders of badges.
D. 
The sale of all beverages, food products or any other commodity shall be prohibited in or upon the swimming facilities or any of the park areas as hereinbefore described, except by permission of the Council.
The tennis court supervisor shall be responsible for the court key during the normal season operations. At other times, a key to the municipal courts shall be available at police headquarters and shall be delivered to any person having a correct permit as provided in this chapter. It shall be the responsibility of the person obtaining the key to return it personally to the Police Department or, upon his or her own responsibility, to entrust it to a person to whom a correct permit has been issued for ultimate return the same day upon completion of play.

The Council shall promulgate and from time to time revise and amend such of the rules and regulations as it deems necessary, advisable or proper for the health, welfare, safety and enjoyment of citizens in the use of all other municipal parks, playgrounds, recreation areas and landfills. When adopted, such rules shall be published for public information and, where appropriate, signing shall be provided for. All such rules and regulations shall have the force of law within the Borough.

No person shall consume any alcoholic beverage within the limits of the Borough of Glen Rock or have in his possession any open alcoholic beverage container with unconsumed alcoholic beverage while:
A. 
In or on a public street, lane, roadway, avenue, sidewalk, public parking place, park, playground, recreation area, school building or grounds or any other public or quasipublic place or in any public conveyance.
B. 
In a private motor vehicle while parked in any public street, lane or parking area, parking lot or any other public or quasipublic place.

C. 
Upon any private property not his own without the permission of the owner or other person having authority to grant such permission.
D. 
No person shall offer or serve any alcoholic beverage to a person under legal age on private property within the Borough of Glen Rock. No person who has ownership or control of any premises, or supervision of any event, shall permit, suffer or allow the consumption of an alcoholic beverage by a person under the legal age in or upon any such premises or at any such event on private property within the Borough of Glen Rock.
E. 
It shall be unlawful for a person under the legal age to knowingly possess or consume alcoholic beverages on private property in the Borough of Glen Rock.

A. 
Prohibited conduct: No person shall feed, in any public park or on any other property owned or operated by Glen Rock, any wildlife, excluding confined wildlife (for example, wildlife confined in zoos, parks or rehabilitation centers).
B. 
Enforcement:
(1) 
This section shall be enforced by the Police Department and/or other municipal officials.
(2) 
Any person found to be in violation of this section shall be ordered to cease the feeding immediately.
C. 
Violations and penalties: Any person(s) who is found to be in violation of the provisions of this chapter shall be subject to a fine not to exceed $1,000.

A. 
It shall be unlawful for any person to smoke within the boundary of any of the public parks, playgrounds, and recreational areas which are defined within § 32-1 of this chapter. To the extent possible, "Smoke Free Zone" signs shall be clearly, sufficiently and conspicuously posted at properties where smoking is prohibited by this chapter. The signs shall have the words "Smoke Free Zone" in lettering that is not less than two inches in height and shall contain the international no smoking sign.
B. 
Notwithstanding the above, smoking shall not be prohibited within the parking lots or vehicular access lanes to such parks, playgrounds and/or recreational areas unless prohibited by other applicable law.
C. 
Violation and penalties. Any person(s) who is found to be in violation of the provisions of this chapter, the maximum penalty shall, upon conviction of a violation, be any combination of the following:
(1) 
A fine not exceeding $1,000 or a period of community service not exceeding 90 days.
(2) 
Application. The maximum penalty is not intended to state an appropriate penalty for each and every violation. Any lesser penalty, including a nominal penalty, may be appropriate for a particular case or a particular violation.
