As used in this article, the following terms shall have the meanings indicated:
Recyclable cans.
Food and beverage containers made entirely of aluminum.

A petroleum-based or synthetic oil which, through use, storage or handling, has become unsuitable for its original purpose due to the presence of impurities or loss of original properties. Automotive waste oil includes used oil from autos, lawn mowers and motorcycles.

The certified Recycling Coordinator and/or his or her appointed designee as the Compliance Officer. The Compliance Officer shall be responsible for all administrative duties and all required reporting, including filing of annual tonnage reports with the appropriate federal, state, and/or county agencies.

Organic matter that has been decomposed and recycled as a fertilizer and soil amendment. Compost is a natural fertilizer and soil amendment made from recycled food scraps, yard waste, sod, and more.

A commercially bought or homemade container used for creating compost. Containers may not exceed two square yards in size and must be placed in conformance with the Borough's Property Maintenance Code.

Asphalt or asphalt-based roofing shingles, concrete, brick, cinder block, ceramic materials, stones, other masonry materials and paving materials. Note: This material must be recycled at a registered, exempted or pending Class B recycling facility. Contact the Recycling Coordinator for a list of registered facilities.

Waste building material and refuse resulting from construction, remodeling and repair operations on houses, commercial buildings and other structures, including concrete, brick, tree parts, nonferrous/ferrous metal, asphalt, and corrugated cardboard. Note: This material must be recycled at a registered, exempted or pending Class B recycling facility. Contact the Recycling Coordinator for a list of registered facilities.

Heavy, brown-colored, stiff paperboard that has a ripple paper core to provide strength; used in making boxes.
Containers and similar paper items usually used to transport supplies, equipment parts or other merchandise.

Those recyclable materials including ferrous scrap (white goods), aluminum, glass containers, plastic containers, corrugated cardboard, newspaper, high-grade paper, junk mail, mixed office and computer paper, automotive waste oil, construction and demolition debris, and tin cans.

All products made of metal, including aluminum, including heavy iron, white goods and light iron.

All products made from silica or sand, soda ash and limestone, the product being transparent or translucent and being used for packaging or bottling of various matter and all other materials commonly known as "glass;" excluding, however, blue and flat glass, commonly known as "window glass."
A solid waste (solid waste includes solids, liquids and compressed gases) that possesses at least one of four characteristics (ignitability, corrosivity, reactivity, or toxicity), or that appears on federal or state official lists of hazardous wastes as set forth in Title 40 of the Code of Federal Regulations (CFR), Part 261; N.J.A.C. 7:26G-5; or pursuant to the Bergen County Utilities Authority rules and/or regulations.

Those materials that are generated from gardens, trees and shrubs shedding their leaves and grass clippings from the mowing of lawns.

All magazines or other periodicals.
All types of paper generated in business offices, homes and schools that is not newsprint or computer paper. It can be a mix of form paper, copy paper, old letters, junk mail or cardboard (food container boxes with the inner envelope removed.)
All paper marketed as newsprint or newspaper and containing at least 70% newsprint or newspaper.

All noncontainer aluminum, stainless steel, copper, zinc, brass and other metals which generally do not rust.

Containers such as polyethylene terephthalate (PETE – No. 1) soda bottles, high-density polyethylene (HDPE – No. 2) milk, water or detergent bottles, low-density polyethylene.

A carter which holds a tariff from the New Jersey Board of Regulatory Commissioners or license from the New Jersey Department of Environmental Protection.

The area designated by the Borough as such where designated recyclable materials may be disposed of in the appropriate receptacles provided. The recycling center is located in Lot 4.02, Block 46.

The Recycling Coordinator responsible for overseeing the recycling center operations, whose duties shall include, but not be limited to, all communication and enforcement matters at the recycling center; interact with all residents' concerns; collecting and gathering any and all statements, reports and payments from outside vendors; and disseminate information to the Compliance Officer as necessary. The Recycling Coordinator shall be appointed on an annual basis.

Includes all garbage, such as materials generated from food or its packaging, which is picked up from the rear yards and rubbish/trash which is in general non-food-related bulk materials, including recyclables, and is picked up from the curb at scheduled times during the month.

Ferrous metal.
Any/all ferrous metal cans used for food and retail consumption, liquids or powders.
Oil removed from the crankcase of a vehicle motor or lawn mower motor. No other types of contaminated fluid such as transmission fluid or hydraulic fluid can be mixed with the used oil.
Includes paper of the type commonly referred to as "newsprint" and distributed at stated intervals, usually daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest. Expressly excluded, however, are all magazines or other periodicals.
All appliances such as washers, dryers, refrigerators, stoves, and hot-water heaters, tire rims, springs, bicycles, bimetal cans (tin cans) or scrap metal, as well as products made from sheet iron, such as shelving, file cabinets, metal desks, recycled or reconditioned steel drums and other nonstructural ferrous scrap.

It shall be mandatory for all for all persons, lessees and occupants, except those physically disabled, of one- to four-family residential properties to separate newspaper, glass containers, aluminum cans, plastic containers, ferrous scrap, white goods, tin cans, and all other mandatory recyclable materials identified below from all other solid waste produced by such residences for collection/deposit and the ultimate recycling of said material.
Designation of mandatory recyclable materials. The following are identified as mandatory recyclable materials:
Aluminum cans;
Glass containers;
Ferrous scrap;
White goods;
Plastic containers (Type 1 and 2);
Automotive waste oil;
Mixed paper;
Used tires;
Corrugated cardboard; and
Construction and demolition debris.

Separation and placing for removal; containers. The occupant or owner of any building within the Borough of Glen Rock who shall place for disposal, removal or collection the following items shall do so in strict conformity with the following regulations.
Newspapers shall be bundled separately and secured in bundles not to exceed 50 pounds and shall not be contained in plastic bags.
Magazines shall be bundled separately and secured in bundles not to exceed 50 pounds and shall not be contained in plastic bags.
Aluminum and steel cans shall be contained in suitable occupant- or owner-supplied containers or such other containers as may be provided by the Borough from time to time.
Plastic containers shall be set at the curb for scheduled pickup or taken to the recycling center on open days. When placed at the curb, recyclable materials shall be put in large plastic containers and care should be taken to prevent recyclable materials from littering the street. The occupant or owner shall do what is necessary to keep lightweight containers from overflowing and littering the street.
Corrugated cardboard shall be cut so it can be flattened, stacked and tied in easy-to-handle bundles. Corrugated cardboard shall not be placed at the curb loose so as to be blown away. Whole corrugated cardboard may be taken to the recycling center and placed in the compactor truck labeled "Corrugated."
Mixed paper, when placed at the curb, must be put in cartons or in large brown paper bags for easy handling. Any type of loose materials that can cause litter shall not be placed at the curb.
White goods.
When a new appliance is purchased, the seller shall arrange to remove and take away the old appliance as part of the purchase agreement.
If necessary, old white goods may be brought to the recycling center and placed at the large roll-off container for scrap metal.
Automotive waste oil shall be placed in a clean plastic or metal (no glass) container that has a cap and taken to a local service station designated as a "recycled oil center." Any commercial establishment is a recycled oil center.
Used tires.
When new tires are purchased, it is recommended that the seller keep the old tires as part of the purchase agreement.
If a service station accepts old tires, a fee of $1 to $2 per tire shall be charged for the cost of disposal. Tires or other vehicle parts placed at the curb for rubbish pickup will not be taken.
Used batteries. The acceptance of used batteries should be part of the new battery purchase agreement; used batteries continue to have recycling value and will often be accepted free of charge.
Household hazardous waste materials. The State Environmental Protection Agency and the New Jersey Department of Environmental Protection and Energy regulations prohibit the Borough from accepting any toxic or hazardous waste materials such as paints, solvents, insecticides, acids, chemicals and poisons, etc., that are accumulated in residential or commercial properties. Residential households can dispose of such materials twice a year when the Bergen County Utility Authority arranges for a county-wide drop-off collection program, which allows for residents to take their materials to the facility. Such materials are then placed in sealed fifty-five-gallon metal drums and shipped to a licensed hazardous landfill for disposal. The county will advertise the date and location of the special hazardous waste collection program once in the spring and once in the fall. The Borough is permitted to take only old latex house paint that is allowed to completely dry out in the open can before being put in the curbside trash.
Leaves. During the months of October through December, as trees and shrubs shed their leaves, residents are to use a mulching mower to mulch the leaves into their lawns, or to gather and collect their leaves and take them to the municipal compost landfill on Doremus Avenue, or they may place them at the curb gutter in a loose pile for removal by the Division of Public Works. Grass clippings and any other garden debris, either loose or containerized, will not be picked up at the curb. Such materials must be composted for recycling by taking them to the Doremus Avenue landfill for composting or by using a composting container on the resident's own property.
Construction and demolition debris. Construction and demolition debris shall be separated and disposed of by the resident through a private scavenger or private recycling company.
All recycling materials placed at the curb, such as used newspapers, magazines, glass, aluminum cans, tin cans, plastic containers and corrugated, for collection by the Borough of Glen Rock in accordance with the terms hereof, shall become the property of the Borough of Glen Rock or its authorized agent. It shall be a violation of this article for any person unauthorized by the Borough of Glen Rock to collect or pick up or cause to be collected or picked up any such recyclables. Each such violation from one or more residences shall constitute a separate and distinct offense punishable as hereinafter provided.

The containers used for recycling shall not be placed at the curb prior to 7:00 p.m. the evening before the Wednesday pickup. Containers must be removed from the curb before sunset on the day of collection.
Owners and/or their tenants of commercial stores, institutions, office buildings, restaurants, bars and industrial-type businesses are hereby required to source-separate from their solid waste generated within their Glen Rock establishments all glass, paper, corrugated paper, aluminum cans, tin cans and plastic container food waste products of fat and bone. If such establishments or businesses are currently recycling any of the above-specified materials, they must keep adequate records of who purchases their recyclable materials, and as to types, volume and dates, and must provide copies of those records monthly to the Borough. Those establishments or businesses not currently source-separating any of the specified recyclables shall either arrange with the Borough's Solid Waste Department to have such materials picked up for recycling or contract with a private disposal company. All such costs directly associated with the Borough's pickup and recycling of the materials for a particular commercial business or institution shall be paid for by that particular business or institution.
Anything herein to the contrary notwithstanding, any person who is an owner, lessee or occupant may donate or sell recyclables to any person, partnership or corporation, whether operating for profit or not-for-profit. Said person, partnership or corporation may not, however, under any circumstances pick up said recyclables from curbside in the Borough of Glen Rock, whether or not said recyclables are placed at curbside on or immediately preceding regular curbside collection.
The Director of Public Works and the Police Department or any other agent as designated by the Borough are hereby authorized and directed to enforce this article. They are hereby authorized and directed to establish and promulgate reasonable regulations as to the manner, days and times for the collection of all recycled materials outlined herein. Such regulations shall be promulgated and effective not later than one month from the date hereof. The Borough Council may, by majority vote, change, modify, repeal or amend any portion of said rules and regulations.

Any person, firm or corporation who violates or neglects to comply with any provision of this article or any regulation promulgated pursuant thereto shall, upon conviction thereof, be punishable by any combination of the following: a fine not exceeding $1,000, imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days.
