There is hereby established and created the
office and position of Municipal Clerk of the Township of Kingwood,
pursuant to the provisions of N.J.S.A. 40A:9-133 et seq.
The Municipal Clerk shall be appointed by the
Township Committee for a three-year term, and the Municipal Clerk
shall achieve tenure in office after five years of service. In order
to obtain reappointment and tenure in the position, the Municipal
Clerk must receive certification by the State of New Jersey as a Municipal
Clerk in accordance with the provisions of N.J.S.A. 40A:9-133.2 et
seq.
The Municipal Clerk shall be paid a salary at
an annual rate as set forth in the current Salary Ordinance of the
Township and shall be subject to all other applicable provisions of
the Salary Ordinance as to holidays, sick leave, and other benefits.
The Municipal Clerk, pursuant to N.J.S.A. 40A:9-133,
shall:
A.
Act as secretary of the municipal corporation and
custodian of the Municipal Seal and of all minutes, books, deeds,
bonds, contracts and archival records of the municipal corporation.
The governing body may, however, provide by ordinance that any other
specific officer shall have custody of any specific other class of
record.
B.
Act as secretary to the governing body, prepare meeting
agendas at the discretion of the governing body, be present at all
meetings of the governing body, keep a journal of the proceedings
of every meeting, retain the original copies of all ordinances and
resolutions and record the minutes of every meeting.
C.
Serve as the chief administrative officer in all elections
held in the municipality, subject to the requirements of Title 19
of the New Jersey Statutes.
D.
Serve as chief registrar of voters in the municipality,
subject to the requirements of Title 19 of the New Jersey Statutes.
E.
Serve as the administrative officer responsible for
the acceptance of applications for licenses and permits and the issuance
of licenses and permits, except where statute or municipal ordinance
has delegated that responsibility to some other municipal officer.
F.
Serve as coordinator and records manager responsible
for supplementing local archives and records retention programs as
mandated pursuant to Title 47 of the New Jersey Statutes.
G.
Perform such other duties as are now or hereafter
imposed by statute, regulation or by municipal ordinance or regulation.
A.
The Municipal Clerk shall serve as the Clerk to the
Township Committee and attend all meetings and keep minutes thereof,
which minutes shall be signed by the Clerk and recorded in a permanent
minute book maintained by the Clerk in the permanent records of the
municipality.
B.
At the close of each year, or periodically throughout
the year, the Township Clerk, with the advice and assistance of the
Township Attorney, or such outside service company, shall collect,
bind, compile and codify all of the ordinances of the Township of
Kingwood.
C.
The Clerk shall have custody of and shall safely keep
all records, books and documents of the Township and, upon request
and the payment of fees as prescribed therefor by resolution of the
Township Committee for the general use of the Township, furnish a
copy of any such paper in the Clerk's custody.
D.
The Clerk shall report to the Township Committee annually,
or at such time as it may require, on the insurance coverages, expiration
dates and premiums of each surety bond and contract of insurance;
the nature and terms of outstanding leases; and all contracts for
work, labor, services, supplies, equipment and materials of the Township.
E.
The Clerk shall have custody of all deeds, leases,
bonds, contracts and archival records of the Township and maintain
such records in accordance with the State-Mandated Retention Program.
F.
The Clerk shall cause to be published in the official
newspaper of the Township all notices of meetings, ordinances introduced
by the Township Committee and notices of adoption thereof, as well
as such other publication and service of notices or actions as required
by law.
G.
The Clerk shall have the power to administer oaths
in all matters concerning Township business.
H.
The Municipal Clerk shall, within five days after
the Township Committee has appointed or elected any officer, whether
to fill a vacancy or otherwise, cause to be delivered to or left at
the place of residence of the person so elected or appointed a notice
of his/her election or appointment and, within the same time, shall
file a certified copy of the record of election or appointment with
the Clerk of the County or as may otherwise be required by law.
I.
The Municipal Clerk shall provide a liaison between
the Township Committee and the departments, boards, committees and
officials of the municipality and other municipal governments, boards
or bodies carrying out similar municipal functions.
J.
The Clerk shall coordinate the functions of all departments
and officers.
K.
The Clerk shall confer with the Township Committee
on all matters of administrative organization, practices, personnel
policies and purchasing.
L.
The Clerk shall assist the Township Committee and
Chief Financial Officer in the preparation of the budget.
M.
The Clerk shall advise the Township Committee on all
background matters as an aid to the establishment of policy and the
carrying out of the functions of municipal government and advise the
Township Committee and other municipal officials on matters affecting
the public interest.
N.
The Clerk shall receive, distribute and follow up
requests for information and complaints from citizens on all matters
or problems and keep the Township Committee informed on such matters.
