Pursuant to Section 11 of the Uniform Fire Safety
Act (P.L. 1983, c. 383), the New Jersey Uniform Fire Code shall be adopted by reference
and locally enforced in the municipality of Lumberton.
The local enforcing agency shall be the Bureau
of Fire Prevention in the Township of Lumberton.

The local enforcement agency shall enforce the
Uniform Fire Safety Act, this chapter, and all related codes and regulations Lumberton
Township.

The local enforcing agency established by this
article shall carry out the periodic inspections of life hazard uses
required by the Uniform Fire Code on behalf of the Commissioner of
Community Affairs.

The local enforcing agency established by §
152-2 of this article shall be under the direct supervision and control of the Fire Official, who shall report to the Township Administrator.

The local enforcing agency shall be under the
supervision of a Fire Official who shall be appointed by Lumberton
Township.

The Fire Official shall serve for a term of
three years. Any vacancy shall be filled for the unexpired term.

Such inspectors and other employees as may be
necessary in the local enforcing agency shall be appointed by Lumberton
Township upon the recommendation of the Fire Official.
Inspectors and other employees of the enforcing
agency shall be subject to removal by Lumberton Township, upon the
recommendation of the Fire Official, for inefficiency or misconduct.
Each inspector or employee to be so removed shall be afforded an opportunity
to be heard by the appointing authority or a designated hearing officer.
Pursuant to Sections 15 and 17 of the Uniform
Fire Safety Act, any person aggrieved by any order of the local enforcement
agency shall have the right to appeal to the Construction Board of
Appeals of Burlington County.

The inspection and permit fees established by
the Uniform Fire Code, as updated, shall be charged by the Fire Official
as follows:
A. Permit application fee. Applicable fees are detailed in the universal fee chart located in §
18-2, reference number 24, of the Code of the Township of Lumberton.

B. Annual registration fees for non-life-hazard uses. Applicable fees are detailed in the universal fee chart located in §
18-2, reference number 25, of the Code of the Township of Lumberton.

C. Cyclical inspections and enforcement of Uniform Fire
Code in hotels and multiple dwellings. Pursuant to the provisions
of N.J.A.C. 5:71-3.6(f), and 3.6(f)(1), the Fire Official is hereby
authorized to inspect hotels and multiple dwellings that are not life-hazard
uses at a frequency of not less than once every five years as is currently
permitted by N.J.A.C. 5:10. The term “hotels” shall mean
hotels, motels, rooming houses and boardinghomes; the term “multiple
dwellings” shall be interpreted to mean building sections containing
more than four dwelling units as well as those containing less than
four dwelling units, unless: 1) the property is held under a condominium
or cooperative form of ownership or by a mutual housing corporation;
2) is in the building that has no occupied dwelling units not occupied
by unit owners, if a condominium, or by shareholders, if a cooperative
or mutual housing corporation; 3) has at least two exterior walls
unattached to any adjoining building section; and 4) is attached to
any adjoining building sections exclusively by fire separation walls
having a one-and-one-half-hour minimum fire-resistance rating, in
the case of buildings constructed prior to January 1, 1977, or as
required by the State Uniform Construction Code at the time of construction.

A. Pursuant to N.J.A.C. 5:70-3.2(a)(5)(iii)(1), the Fire Official may
require and designate public or private fire lanes and/or fire zones
as deemed necessary for the efficient and effective use of fire apparatus
and emergency response vehicles. Unless stated to the contrary, the
phrases "fire lanes" and "fire zones" shall be identical in meaning
and used interchangeably. Designated fire lanes and fire zones shall
be appropriately posted with notices indicating either "no parking-fire
zones" or "no parking-fire lanes" and may be marked with yellow lines
at least four inches wide.
B. The Bureau of Fire Prevention will create and maintain a registry
of fire zones designated under this article, a copy of which will
be attached as Appendix A with copies available to the public at the
offices of the Bureau of Fire Prevention.

Parking in a marked fire lane shall be deemed a traffic violation
and a violation of this article. Unless another penalty is expressly
provided for by New Jersey statutes or regulation, any person convicted
of a violation of this section shall be subject to a fine of $100.
The Police Department of the Township of Lumberton and the Bureau
of Fire Prevention shall have concurrent authority to issue citations
under this section. Further, the Police Department of the Township
of Lumberton shall have the authority to cause said vehicle found
in violation to be towed and stored at the expense of the owner.
On all future commercial establishments, including apartments,
the Planning Board shall require the applicant to submit a copy of
the plans to the Bureau of Fire Prevention for review and recommendations
regarding fire lanes. The Planning Board shall consider the advice
of the Bureau of Fire Prevention when determining the placement of
fire lanes at each such establishment. Final approval of the plans
shall require that the applicant request adoption by the governing
body of an ordinance designating the agreed-upon fire lanes.
The signs and painting designation required hereunder shall
be provided by the owner of the respective establishments covered
by this section at his or its expense and shall, in any event, be
completed before the certificate of occupancy is issued. If not so
completed, the Township may take the necessary steps to obtain compliance
and bill the owner for the reasonable cost thereof.
