Editor's Note: This ordinance also provided

The purpose of this chapter is to regulate all
games of chance held, operated or conducted within the Borough, pursuant
to the Acts of the Legislature of the State of New Jersey known as
the "Bingo Licensing Law," N.J.S.A. 5:8-24 et seq., and the "Raffles
Licensing Law," N.J.S.A. 5:8-50 et seq., and in accordance with the
rules and regulations issued or to be promulgated by the Legalized
Games of Chance Control Commission of the State of New Jersey. All
applications, licenses and proceedings in connection therewith shall
be subject to the provisions of the Acts and the rules and regulations
and any laws, rules and regulations hereinafter enacted, and shall
be further subject to the provisions of this chapter.
No organization not having a bona fide situs
established in good faith within the State of New Jersey and actively
engaged in serving one or more of the authorized purposes, as defined
by the rules and regulations of the Legalized Games of Chance Control
Commission, shall be issued a license to conduct a game or games of
chance as authorized by law.
Any game of chance operated within the borough pursuant to a license issued in accordance with § 88-1 hereof may be operated by the holder of said license, in accordance with law, on the first day of the week, commonly known and designated as "Sunday"; provided, however, that the license so issued shall first specifically provide for the operation of said game of chance on Sunday.
B.
Bingo. Qualified organizations applying for a bingo
license shall pay, in addition to the fee established by the State
of New Jersey, a fee to the Borough as follows:

Per event: $5.
C.
For on-premises draw raffles for cash prizes (50/50) that do not
exceed $400 or merchandise prizes with a total combined retail value
of prizes awarded does not exceed $400, there shall be no licensing
fee. In the event the retail value of the prize(s) offered or awarded
should exceed $400 in a raffle in which it was anticipated that the
retail value would not exceed $400, the licensee shall submit a check
or money order made payable to the Legalized Games of Chance Control
Commission in the amount of $20 at the time of filing the report of
operations required by N.J.A.C. 13:47-9 and shall pay a fee to the
Borough of Stanhope of $5, together with a copy of the report of raffle
operations.

D.
In the event any licensee wishes to conduct any other legalized game
of chance, as permitted by state law, the licensee shall pay a license
fee to the Borough equal to the fee charged by the Legalized Games
of Chance Control Commission pursuant to law.

The issuing authority responsible for approving bingo and raffle
licenses, as the same is defined in N.J.S.A. 5:8-24 et seq. and N.J.S.A.
5:8-50 et seq., shall be the Borough Clerk.
