The office of Zoning Officer of the Borough of Stanhope is hereby created. The Officer shall be appointed by the Mayor with the advice and consent of the Council and shall hold office until January 1 next following the appointment. Any vacancy in the office shall be filled only for the unexpired portion of the term.
A. 
Zoning permits shall hereafter be secured from the Zoning Officer prior to construction, erection or alteration of any structure or part of a structure or land. All requests for zoning permits shall be made in writing by the owner or his authorized agent and shall include a statement of the use or intended use and shall be accompanied by a plan of the plot showing thereon the exact size, shape and location of all proposed structures and such other information as may be necessary to provide for the enforcement of this chapter. The zoning permits shall be granted or denied within 10 business days from the date that a written application is filed with the Zoning Officer. In the event that the zoning permit application raises technical questions of an engineering nature, the Zoning Officer shall have the option of requiring the payment of an escrow by the applicant of an amount not to exceed $500 for purposes of having the Borough Engineer review and comment on the zoning application prior to the Zoning Officer acting thereon. If an escrow is required, the Zoning Officer’s time to act on the zoning permit application shall commence upon the payment of the applicable escrow by the applicant.

B. 
Site plan review required; exception. Site plan review and approval shall be required as a condition for the issuance of a zoning permit for any development, except that individual lot applications for detached one- or two-dwelling-unit buildings shall be exempt from site plan approval.

A building permit issued in accordance with the Building Code of the Borough pursuant to the provisions thereof shall be issued only after or coincident with the issuance of a zoning permit certifying that the application is in compliance with all provisions of the Zoning Chapter or approved variance therefrom.
D. 
A building permit shall be secured from the Construction Official prior to the construction, erection or alteration of any building or structure or part thereof and prior to the putting into use of any land or part thereof.

The Zoning Officer shall be the chief enforcing agent of the provisions of this chapter pursuant to § 100-15 hereof.
B. 
Records. It shall be the duty of the Zoning Officer to keep a record of all applications for zoning permits issued, together with a notation of all special conditions involved. He shall file and safely keep copies of all plans submitted, and the same shall form a part of the records of his office and shall be available for the use of the Borough Council and of other officials of the Borough.
C. 
The Zoning Officer shall prepare a monthly report for the Borough Council summarizing for the period since his last previous report all zoning permits issued by him and all complaints of violations and the action taken by him consequent thereon. A copy of each such report shall be filed with the Borough Tax Assessor at the same time it is filed with the Borough Council.
