This article shall hereafter be known and cited
as the "Fee Law of the Town/Village of East Rochester."
This article is enacted pursuant to § 10 of the Municipal Home Rule Law and Chapter 24, Adoption of Local Laws, of the Code of the Town/Village of East Rochester.
This article shall apply to the entire area
of the Town/Village of East Rochester.

It is the intention of this article to establish
fees to be charged by the various departments and officials of the
Town/Village of East Rochester, including, but not limited to, the
Town/Village Clerk-Treasurer, Building Department and Department of
Public Works.
The fees and charges imposed by the Town/Village
of East Rochester shall be set by resolution by the Town/Village Board
of Trustees from time to time. The schedule of fees shall be on file
in the Town/Village offices.

An engineering review fee shall be paid by any applicant or his agent whenever the services of the Town/Village Engineer are required to review sketches, plats or plans submitted to any board of the Town/Village, the Department of Public Works or the Building Inspector. Such fee shall apply to all types of building and development and to all districts and to all proceedings of any board of the Town/Village mentioned in Chapter 193, Zoning, as well as such other matters as are required by any other section of the Code of the Town/Village of East Rochester relating to construction, building and development, etc., where the services of the Town/Village Engineer are required to review sketches, plats or plans on behalf of the Town/Village or any of its boards or departments.
The payment of such fee shall be a prerequisite
before any board of the Town/Village or its departments shall hear
the applicant wherein it is required that the services of the Town/Village
Engineer are necessary to review any or all sketches, plats or plans
to be submitted by said applicant. No application shall be heard or
reviewed by said boards or departments of the Town/Village nor shall
the Town/Village Engineer undertake any review of the sketches, plats
or plans until the appropriate engineering review fee has been paid
and collected by the Town/Village Clerk-Treasurer.
The engineering review fees shall be as set
from time to time by resolution of the Board of Trustees.
A.
When the Town/Village Engineer is required to review
in two stages (preliminary and final), then the applicant or his agent
shall pay 1/2 of the engineering review fee upon submission for preliminary
review of such sketches, plats or plans and 1/2 of the fee upon submission
for final review.
B.
When the sketches, plats or plans are able to be reviewed
as a one-stage review by the Town/Village Engineer, then the required
fee shall be paid in full, as heretofore directed, before any board,
department or officer of the Town/Village shall grant final approval
for building permits.
