[HISTORY: Adopted by the Governing Body of the Town/Village of East Rochester 2-9-1983 by L.L. No. 2-1983 as Ch. 100 of the 1983 Code. Amendments noted where applicable.]
This chapter shall be known as the "Games of Chance Law" of the Town/Village of East Rochester.
As used in this chapter, the following terms shall have the meanings indicated:
AUTHORIZED ORGANIZATION
An authorized organization as defined in § 186, Subdivision 4, of the General Municipal Law.
GAME OF CHANCE
A game of chance as defined in § 186, Subdivision 3, of the General Municipal Law.

Authorized organizations may, upon obtaining a license from the Clerk-Treasurer of the Town/Village, conduct games of chance within the Town/Village, as provided in Article 9-A of the General Municipal Law and as provided further in this chapter. Such games of chance shall be conducted in accordance with the general state law and with the rules and regulations of the New York State Gaming Commission and this chapter.
Games of chance on the first day of the week, commonly known as "Sunday," may be conducted pursuant to this chapter and appropriate statute and regulation.
The Chief of Police or his designee shall exercise control over and supervision of all games of chance conducted under an appropriately issued license. Such officer shall have all those powers and duties set forth in Article 9-A of the General Municipal Law.

Any person violating any provision of this chapter or the terms of any license issued hereunder shall be subject to the penalties provided in Article 9-A of the General Municipal Law, §§ 195-j and 195-k.
This chapter shall take effect immediately upon filing with the Secretary of State's office and posting and publication required by law, following its approval at referendum by a majority of qualified voters voting thereon at a special election held pursuant to the provisions of § 24 of the Municipal Home Rule Law.[1]
