No person, corporation or association shall engage in the business of maintaining or operating a junkyard anywhere within the territorial limits of the Town/Village of East Rochester, except as allowed in accordance with Chapter 193, Zoning.
As used in this chapter, the following terms shall have the meanings indicated:
JUNK
Any discarded, worthless, meaningless, contemptible or mere trash, material, goods or personal property, such as but not limited to metal, paper, rags, wood products, worthless autos or other worthless vehicles.
JUNKYARD
A lot, land or structure or part thereof used primarily for the collection, storage and sale of wastepaper, rags, scrap metal or discarded material or for the collecting, dismantling, storing and salvaging of machinery or vehicles not in running condition and for the sale of parts thereof.

Any person violating this chapter shall, upon conviction, be liable to a fine not exceeding $250 or to imprisonment for a term not exceeding 15 days, or to both such fine and imprisonment, for each violation.
