[HISTORY: Adopted by the Governing Body of the Town/Village of East Rochester 2-9-1983 by L.L. No. 2-1983 as Ch. 135 of the 1983 Code. Amendments noted where applicable.]

As used in this chapter, the following terms shall have the meanings indicated:
PARK
All lands and waters for the recreational use of the public, including parks, playgrounds and public squares, under the control and supervision of the Town/Village Board.

The walks in parks shall be used exclusively by pedestrians, except that baby carriages and personal assistive mobility devices and children's carts and tricycles may be propelled thereon. This section shall not apply to vehicles used by order of the Superintendent of Public Works.
The following regulations shall apply within any park:
A. 
Alcoholic beverages.
(1) 
The consumption of alcoholic liquors, beers or beverages and the bringing into or the possession of the same in any of the Town/Village parks is hereby permitted only under the following conditions: that said alcoholic liquors, beer or beverages shall only be consumed in those areas designated for consumption by either the Superintendent of Public Works, the Town/Village Board of Trustees or the Town/Village Clerk-Treasurer. No intoxicating beverages, however, shall be consumed in said parks nor dispensed or displayed at any temporary bars or from kegs or other bulk dispensing units unless special permission is first obtained from the Clerk-Treasurer, Superintendent of Public Works or Trustees.
(2) 
The consumption or possession with intent to consume of any alcoholic beverages or liquors is hereby restricted and prohibited in the parking lots, park roads or rights-of-way within said park, nor shall any person become intoxicated in any area within said park.
B. 
No person shall throw, dump or drain any materials or substances of any kind into any park grounds or park waters.
C. 
No person shall commit any of the following acts within any park without the consent of the Department of Public Works or some person duly authorized to act for it:

(1) 
Keep or offer anything for sale.
(2) 
Play any music.
(3) 
Post or display any sign, banner or advertisement.
(4) 
Solicit passengers for any vehicle for hire.
(5) 
Obstruct any roadway or path.
(6) 
Discharge any firearms or fireworks or send up any balloon.
(7) 
Permit any animal except horses or dogs to enter said parks.
(8) 
Conduct a funeral procession.
(9) 
Enter or leave any park except at the established ways of entrance and exit.
(10) 
Violate the regulations of the Department of Public Works relating to any building or place or the use of any park facility.
(11) 
Slide, use a snowmobile, use a motorcycle or use any other unregistered motor vehicle, ski, toboggan, sleigh or skate, except at such times and such places as may be designated by the Department of Public Works for that purpose.
No person or group shall be allowed in any Town/Village park after 10:00 p.m. and before 5:00 a.m., except when prior authorization has been granted by the Superintendent of Public Works.
The Town/Village shall charge a cleanup user's fee as set from time to time by resolution of the Board of Trustees to organizations from the Town/Village for use of the total facilities of any Town/Village park, said fee to be refunded upon proper cleanup.
Any person who shall violate any of the provisions of this chapter shall, upon conviction, be punishable by a fine of not more than $250 or by imprisonment for a term of not more than 15 days, or by both such fine and imprisonment.
