The Fire Chief, or duly authorized representatives, as may be in charge at the scene of a fire or other emergency involving the protection of life and/or property is empowered to direct such operations as may be necessary to extinguish or control any suspected or reported fires, gas leaks or other hazardous conditions or situations, provide emergency medical care or take any other action necessary in the reasonable performance of his duty. The Fire Chief may prohibit any person, vehicle or object from approaching the scene and may remove or cause to removed from the scene any person, vehicle or object which may impede or interfere with the operations of the Fire Department. The Fire Chief may remove or cause to be removed any person, vehicle or object from hazardous areas. All persons ordered to leave a hazardous area shall do so immediately and shall not reenter the area until authorized to do so by the Fire Chief.
It shall be unlawful to interfere with, attempt to interfere with, conspire to interfere with, obstruct or restrict the mobility of or block the path of travel of any Fire Department emergency vehicle in any way, or to interfere with, attempt to interfere with, conspire to interfere with, obstruct or hamper any Fire Department operation.
A person shall not willfully fail or refuse to comply with any lawful order or direction of the Fire Official or Fire Chief or to interfere with the compliance attempts of another individual.
A vehicle shall not be driven or propelled over any unprotected fire hose of the Fire Department when laid down on any street, alleyway, private drive or any other vehicular roadway without the consent of the Fire Chief in command of said operation.
A person shall not, without proper authorization from the Fire Chief in charge of said Fire Department emergency equipment, cling to, attach himself to, climb upon or into, board or swing upon any Fire Department emergency vehicle, whether the same is in motion or at rest, or sound the siren, horn, bell or other sound-producing device thereon, or manipulate or tamper with or attempt to manipulate or tamper with any levers, valves, switches, starting devices, brakes, pumps or any equipment or protective clothing on or a part of any Fire Department emergency vehicle.
It shall be unlawful for any person to damage or deface or attempt or conspire to damage or deface any Fire Department emergency vehicle at any time or to injure or attempt to injure or conspire to injure Fire Department personnel while performing departmental duties.
It shall be unlawful to obscure from view, damage, deface, obstruct or restrict the access to any fire hydrant or any Fire Department connection for the pressurization of fire-suppression systems, including fire hydrants and Fire Department connections that are located on public or private streets and access lanes or on private property.

It is the responsibility of the owner or occupant to have snow removed from their property in a manner which will not delay the response of emergency personnel. Snow shall be removed or cleared within eight hours of sunrise after a snowfall. Removal of snow shall not obstruct the following:
A. 
Access to the parking lot, to the perimeter of any building, and any fire lanes or "NO PARKING" designated areas.
B. 
All fire hydrants.
C. 
All means of egress and exit doors.
D. 
All fire protection systems and Fire Department water supply connections.

A. 
A person shall not use or operate any fire hydrant intended for use of the Fire Department for fire-suppression purposes unless such person first secures a permit for such use from the Fire Official and the water company having jurisdiction. This section shall not apply to the use of such hydrants by a person employed by and authorized to make such use by the water company having jurisdiction.
(1) 
It shall be unlawful to obscure from view, damage, deface, obstruct, or restrict the access to any fire hydrant or Fire Department connection, including fire hydrants and Fire Department connections that are located on public or private streets, access lanes, or on private property.
B. 
The Fire Official shall report to the Planning Board, the Zoning Board, the property owner, and/or the Director of the Municipal Utility Authority or his designee having jurisdiction on land use, subdivision(s), site plan(s), temporary use permits, and zoning approvals. The applicant shall prepare plans in accordance with the requirements adopted herein. The applicant shall be responsible for off-site improvements that affect the site fire flow requirements adopted herein.
C. 
Fire hydrants, water supplies, and Fire Department connections:
(1) 
Required water supply for fire protection: An approved water supply capable of supplying the required and reliable fire flow for fire protection shall be provided to all premises upon which facilities, buildings, uses, or portions of the buildings or uses are hereafter constructed.
(2) 
Type of water supply: Water supply is permitted to consist of reservoirs, pressure tanks, elevated tanks, water mains or other fixed systems capable of providing the required fire flow. In setting the requirements of fire flow, the Fire Official shall be guided by the current edition of the International Fire Code and the Appendix titled "Fire-Flow Requirements for Buildings."
(3) 
Fire Department connections: All buildings equipped with Fire Department water supply connections shall be labeled and marked for ease of identification. The following guidelines will be utilized for the identification of all Fire Department connections. Any alternative method must be approved by the Fire Official.
(a) 
A weather-resistant sign shall be affixed to, adjacent to or above the Fire Department connection. Specifications for the sign area are as follows:
[1] 
Sign to be white in color with contrasting red lettering.
[2] 
Minimum four-inch letters indicating "F.D.C."
[3] 
Minimum two-inch letters indicating sprinkler, standpipe or sprinkler/standpipe.
[4] 
Partial sprinkler systems: two three-inch letters indicating area protected.
[5] 
Interior standpipe connections within structures, in some cases will require additional plain language on signs to identify location, particular system and supply location.
(4) 
Fire hydrant locations and distribution:
(a) 
Location and number of fire hydrants: Fire hydrants shall be provided when required in accordance with the current edition of the International Fire Code and the Appendix titled "Fire Hydrant Locations and Distribution."
(b) 
Buildings equipped with a standpipe system shall have a fire hydrant within 50 feet of the Fire Department connections.

Any proposed development within Evesham Township will comply with the minimum requirements for Fire Department accessibility set forth in the current edition of the International Fire Code and the Appendix titled "Fire Apparatus Access Roads."
A person shall not sell, trade, loan or give away any form, type or kind of fire extinguisher which is not approved by the Fire Official or which is not in proper working order or the contents of which do not meet the requirements of the Fire Official. The requirements of this section shall not apply to the sale, trade or exchange of obsolete or damaged equipment for junk when said units are permanently disfigured or marked with a permanent sign identifying the unit as junk.
A person or persons shall not erect, construct, place or maintain any bumps, fences, gates, chains, bars, pipes, wood or metal horses or any other type of obstruction in or on any street within the boundaries of the municipality unless approved by the Fire Official.

A. 
The application fee for a certificate of smoke detector and carbon monoxide alarm compliance (CSDCMAC), as required by N.J.A.C. 5:70-2.3, shall be based upon the amount of time remaining before the change of occupant is expected, as follows:
(1) 
Requests for a CSDCMAC received more than 10 business days prior to the change of occupant: $70;
(2) 
Requests for a CSDCMAC received four to 10 business days prior to the change of occupant: $115;
(3) 
Requests for a CSDCMAC received fewer than four business days or less prior to the change of occupant: $160;
(4) 
A fee of $35 shall be assessed for all required reinspections. A third visit will require a new application and new fee.
B. 
Apartment units not owner-occupied shall be inspected prior to be occupied by every new tenant. The same fee as specified in Subsection A above shall be utilized for apartment inspections. The first reinspection of an apartment will pay the fee of $35. A third visit will require a new application and new fee.
C. 
Low-voltage fire alarm systems shall be tested and inspected by a New Jersey licensed fire alarm contractor. All testing and inspections shall be completed within the requirements established by the National Fire Protection Association's National Fire Alarm and Signaling Code (NFPA 72). Certification of the test and inspection shall be presented to the Fire Department inspector on the scheduled inspection date and shall be dated no more than 30 days from the date of the CSDCMAC inspection. All fees outlined in Subsection A apply to this inspection.
Residential structures to have portable fire extinguishers (N.J.S.A. 52:27D-198.1). Each structure, other than a seasonal rental unit, shall also be equipped with at least one portable fire extinguisher in conformance with rules and regulations promulgated by the Commissioner of Community Affairs pursuant to the "Administrative Procedure Act," P.L. 1968, c. 410 (N.J.S.A. 52:14B-1 et seq.). For the purposes of this section, "portable fire extinguisher" means an operable portable device, carried and operated by hand, containing an extinguishing agent that can be expelled under pressure for the purpose of suppressing or extinguishing fire, and which is: 1) rated for residential use, consisting of an ABC type; 2) no larger than a ten-pound-rated extinguisher; and 3) mounted within 10 feet of the kitchen area, unless otherwise permitted by the enforcing agency. "Seasonal rental unit" means a dwelling unit rented for a term of not more than 125 consecutive days for residential purposes by a person having a permanent residence elsewhere, but shall not include use or rental of living quarters by migrant, temporary or seasonal workers in connection with any work or place where work is being performed.

A. 
The fees set forth below shall be charged for use of services outside the normal scope of duties of the Fire District, including but not limited to, fire watch standbys requested by a member of the public or business, cleanups, and other duties specifically requested by the public or required by the public to be performed by the Fire District, or upon determination that the use of the Fire District resources was required due to deliberate, negligent, or willful criminal conduct.
B. 
Services outside the normal scope of duties of the Fire District. In the event a request is made for a service or services outside of the normal scope of duties in the Fire District, the person, company, or owner shall be charged for said request in accordance with the fees set forth below.
C. 
If upon investigation it is determined that an incident was caused by deliberate, negligent, or willful criminal conduct of an individual or a group of individuals, the responsible person(s) will be liable for all Fire Department apparatus and personnel costs associated with the response and/or incident.
(1) 
The following fees shall be charged for each hour, or portion thereof, of usage. All fees shall be based on departure and return to the station to which the apparatus is assigned.

D. 
Any employee or volunteer member of the Evesham Township Fire District No. 1 subpoenaed to testify in civil court or a deposition shall appear, and compensation to the Evesham Township Fire District No. 1 shall be set forth as follows in the table which provides for incremental increases per fiscal year. The minimum compensation to the Fire District will be a minimum of four hours.

E. 
An uninterrupted ninety-minute investigative conference or meeting at the Evesham Township Fire District No. 1 Administration Office, on site, or at a location designated by the requestor shall be set as follows and in accordance with the table which outlines the incremental increases per fiscal year.
