This article shall be known as the "Stormwater Quantity and Quality Control Regulations of the Township of Manalapan."
It is hereby historically found that disastrous floods which have occurred in the past have caused significant damage to public and private property, health, safety and general welfare. It is further found that the significant increase in flood occurrences is partially due to an increase in stormwater runoff as a result of the development of lands with impermeable surfaces in and around the community. It is therefore determined that the special public interest in the control of stormwater justifies the regulation of property located within the community as provided in this article, which is the exercise of the police power of the municipality for the protection of persons and property and for the preservation of the public health, safety and welfare.
No land area shall be developed by any person, partnership or corporation unless it has been demonstrated that such development shall not increase the quantity of stormwater runoff emanating from the developed area beyond that quantity, which in combination with existing and anticipated full development of the contributary area, can be absorbed by the Township's stormwater drainage system. It shall be the responsibility of the Township Engineer to determine the capacity of the stormwater drainage system and the quantity of stormwater that can be absorbed from the developed area.
A. 
Prior to the grant of final approval of the subdivision, by the Planning Board and the Township Committee, the Township Engineer shall have reviewed the volume of stormwater to be generated from the proposed development and the method for its disposition.
B. 
In the event that the quantity of stormwater runoff is in excess of the amount that can be absorbed by the Township's stormwater drainage system as determined by the Township Engineer under the provisions of § 201-3 of this article, no building permit shall be issued.
