All ordinance of the Board of Health of the
Township of Manalapan of a general and permanent nature are ordained
as general ordinances and are hereby authorized for inclusion in,
and are adopted as part of, the Code of the Township of Manalapan,
State of New Jersey.
All provisions of the Code of the Township of
Manalapan, County of Monmouth, State of New Jersey, including the
ordinances of the Board of Health of the Township of Manalapan, shall
remain in force and effect on and after the effective date of this
ordinance.
In compiling and preparing the ordinances of
the Board of Health of the Township of Manalapan, New Jersey, certain
grammatical changes and other minor changes were made. It is the intention
of the Board of Health that all such changes be adopted as part of
the Code. In addition, various substantive amendments have been made
to the ordinances of the Board of Health, Township of Manalapan, as
amended and supplemented, and it is the intention of the Board of
Health that these amendments be adopted as part of the Code of the
Township of Manalapan, New Jersey.
If any chapter, article, section, subsection,
paragraph, subparagraph, sentence or clause of the ordinances of the
Board of Health of the Township of Manalapan is declared constitutionally
invalid, unenforceable or inoperative, in whole or in part, by a court
of competent jurisdiction, no such determination shall be deemed to
invalidate the remaining chapters, articles, sections, subsections,
paragraphs, subparagraphs, sentences or clauses of the ordinances
of the Board of Health, Township of Manalapan, New Jersey.
Any and all additions, amendments or supplements
to this Part III, when passed and adopted in such form as to indicate
the intent of the Board of Health of the Township of Manalapan to
make them a part thereof, shall be deemed to be incorporated into
this Part III so that references to the "Code of the Township of Manalapan,
New Jersey," or "Code" shall be understood and intended to include
such additions and amendments. Whenever such additions, amendments
or supplements to this Code shall be adopted, they shall thereafter
be printed and, as provided herein, inserted in the loose-leaf book
containing the Code, ordinance amendments and supplements thereto.
A copy of the Code of the Township of Manalapan,
New Jersey, in loose-leaf form containing the ordinances of the Board
of Health of the Township of Manalapan shall be filed in the office
of the Township Clerk and shall remain there for use and examination
by the public, and such copy shall be certified to by the Township
Clerk of the Township of Manalapan by impressing thereon the Seal
of the Township as provided by law, and such certified copy shall
remain on file in the office of the Township Clerk, to be made available
to persons desiring to examine the same during all times while the
Code is in effect.
All ordinances and parts of ordinances inconsistent
with this ordinance are hereby repealed. The adoption ordinance and
the Code of the Township of Manalapan, New Jersey, shall supersede
all provisions of the Revised General Ordinances of the Township of
Manalapan, New Jersey, as amended and supplemented, except as provided
herein.
