GENERAL REFERENCES

This chapter shall be known and may be cited and referred to as the
"Snow Hill Civil Emergencies Ordinance."
The purpose of this chapter is to protect the public health, safety
and welfare of the Town of Snow Hill inhabitants by establishing regulations
for the conduct of persons in the Town of Snow Hill should a civil emergency
exist and be declared by the Mayor of the Town of Snow Hill and to provide
for enforcement and penalties of violations of these regulations.
As used in this chapter, the following terms shall have the meanings
indicated:
A riot or unlawful assembly characterized by the use of actual force
or violence or any threat to use force if accompanied by immediate power to
execute the same by three (3) or more persons acting together without authority
of law.
Any natural disaster or man-made calamity including flood, conflagrations,
cyclone, tornado, earthquake or explosion within the corporate limits of Snow
Hill resulting in the death or injury of persons or in the destruction of
property to such an extent that extraordinary measures must be taken to protect
the public health, safety and welfare.
A prohibition against any person or persons walking, running, loitering,
standing or motoring upon any alley, street, highway, public property or vacant
premises within the corporate limits of Snow Hill, except persons officially
designated to duty with reference to said civil emergency.
When, in the judgment of the Mayor of Snow Hill or, in his absence,
the Secretary of the Council, a civil emergency, as defined herein, is deemed
to exist, he shall forthwith proclaim, in writing, the existence of the same.
After the proclamation of a civil emergency by the Mayor or Secretary
of the Council, he may order a general curfew applicable to such geographical
areas of the town or to the town as a whole as he deems advisable, and said
curfew should be applicable during such hours of the day or night as he deems
necessary in the interest of the public safety and welfare.
After the proclamation of a civil emergency, the Mayor or the Secretary
of the Council, as the case may be, may also in the interest of public health,
safety and welfare make any or all of the following orders:
A.
Order the closing of all retail liquor stores.
B.
Order the closing of all taverns or restaurants.
C.
Order the closing of all private clubs or portions thereof
wherein the consumption of intoxicating liquor and beer is permitted.
D.
Order the discontinuance of sale of all alcoholic beverages.
E.
Order the discontinuance of selling, distributing or
giving away of gasoline or other liquid flammable or combustible products
in any container other than a gasoline tank which is an integral part of a
motor vehicle.
F.
Order the closing of gasoline stations or other establishments,
the chief activity of which is the sale, distribution or dispensing of liquid
flammable or combustible products.
G.
Order the discontinuance of selling, distributing, dispensing
or giving away of any firearms or any ammunition of any character whatsoever.
H.
Order the closing of any or all establishments or portions
thereof, the chief activity of which is the sale, distribution or dispensing
or giving away of firearms and/or ammunition.
I.
Order the temporary closing of any and all streets, alleys
or other public ways in the Town of Snow Hill.
J.
Issue such other orders as are imminently necessary for
the protection of life or property.
Should the Mayor or Secretary of the Council deem it necessary to invoke any or all of the provisions of §§ 68-1 through 68-5 of this chapter, inclusive, he shall give notice of the same by means of a written proclamation posted in the Town Hall and issued to the communications media for immediate dissemination to the public.
Any persons violating the provisions of this chapter or executive order
issued pursuant thereto shall be guilty of a misdemeanor and shall be punished
by a fine not to exceed one thousand dollars ($1,000.) and/or imprisonment
for a period not to exceed six (6) months, or both.
