This article shall be known as "Lascivious Conduct With Minors."
It shall be unlawful for any person 18 years of age or older to, with
lascivious intent, knowingly and intentionally expose his or her sexual or
genital parts to any child under the age of 14 years to whom such person is
not legally married, or propose that any such child expose his or her sexual
or genital parts to such person.
As used in this article, the following terms shall have the meanings
indicated:
LASCIVIOUS
Has its ordinary meaning of lewd or lustful conduct. The
circumstances surrounding the event, any inducements, threats, objects, utterances
or suggestions made by the person can also be used to infer lascivious intent.
It describes a state of mind that is eager for sexual indulgence, desirous
of inciting to lust or of inciting sexual desire and appetite.
Any duly authorized law enforcement officer may enforce the provisions
of this article.
Any person who shall violate the provisions of this article shall be
deemed guilty of a misdemeanor and shall be punished by a fine up to $1,000
and/or six months' imprisonment.
