This Article shall be known as the "Snow Hill Sewage Charges Ordinance," and the provisions therein contained are hereby adopted for the purpose of establishing the manner in which the charges for the operation and maintenance of the sewage system, including the sewage treatment plant, of the Town of Snow Hill shall be established and collected from the users thereof.
The provisions of this Article shall apply to all users of the sewage system, whether within or without the corporate limits of Snow Hill.

Each user of the sewage system shall pay such charges as are established from time to time by duly enacted resolution of the Mayor and Council of Snow Hill.[1]

Where the Mayor and Council are permitted to charge a surcharge under the provisions of § 193-35C(15) of Article III of this chapter, said surcharge shall be based upon the following formula:
Cs = [Bc (B) + Sc (S) + Pc (P)] Vu
Where:
Cs = A surcharge for wastewater of excessive strength (cost in dollars).
Bc = O & M cost for treatment of a unit of biochemical oxygen demand (BOD) (cost per pound of BOD).
B = Concentration of BOD from a user above a base level (pounds per MG).
Sc = O & M cost for treatment of a unit of suspended solids [cost per pound of suspended solids (SS)].
S = Concentration of SS from a user above a base level (pounds per MG).
Pc = O & M cost for treatment of a unit of any pollutant (cost per pound).
P = Concentration of any pollutant from a user above a base level (pounds per MG).
Vu = Volume contribution from a user per unit of time (MG per time period).
MG = Million gallons.

The annual sewage charge calculated in accord with the provisions of this Article shall be due and payable quarterly on the first days of January, April, July and October and shall be collected as water bills are now collected and shall be liens on the real estate against which the charges are respectively imposed. Any such charges not paid within 45 days of the date billed shall bear interest at the rate of 1 1/2% per month until paid. In any case where the sewage charge shall be delinquent as aforesaid, the Mayor and Council, after 10 days' notice sent, may discontinue water and sewer services to said property or user until such time as said delinquent charge and all accrued interest are paid, the cost of discontinuing and reconnecting said water and sewer service to be at the expense of the delinquent property owner or user.

The collector of taxes of the Town of Snow Hill is hereby charged with the duty of collecting said sewage charges and is hereby vested with all necessary authority to collect the same as water bills are now collected.
A. 
EDU in/out-of-Town rate. FY 2022 through FY 2024 (July 1, 2021 through June 30, 2024):

Each user is allowed five EDUs minimum at 22,500 gallons per EDU, totaling 112,500 gallons per quarter. Usage over 112,500 gallons will be charged $27 for water and $55 for sewer per EDU or portion over.
All such sewage charges collected shall be used solely for the payment of the operating and maintenance expense of the sewage system, including the sewage treatment plant, as the same may be constituted from time to time, and for improvements thereto and for paying the principal and interest on bonds issued for the purpose of providing funds for construction and maintenance of the sewage system and the sewage treatment plant as the same shall be due and payable.
