Definitions of terms as used in this article, unless the context otherwise indicates, are dictated by the following:
DOG
Both male and female.
OWNER
Any person or persons, firm, association or corporation keeping, harboring or owning a dog.
RUNNING AT LARGE
Off the premises, residence or property of the owner and not under the direct control of the owner or some responsible individual, whether by leash, cord, chain or other restraint device.
It shall be unlawful to permit any dog to run at large within the City of Franklin.
Any dog found running at large may be restrained or impounded by an animal control officer of the Franklin Police Department. Any animal so impounded may be confined in a suitable facility for a reasonable period of time. Impounded dogs not claimed by the owners within 72 hours after notice to the owner, if known, may be humanely disposed of by an animal control officer of the Franklin Police Department. Dogs impounded not wearing a valid rabies vaccination tag must be impounded for a period of seven days in accordance with R.S.A. 436:107 (Rabies Control Act) before disposal.

The owner of any dog subject to the provisions of this article or any other local or state regulations dealing with municipal custody of such animals shall be liable to the city in an amount equal to all expenses associated with the capture, impoundment, maintenance or any other expense associated with the animal. The sole exception to this provision shall be in the event that any limitation upon such recovery is required by state law.
A. 
Any owner or individual claiming a dog impounded shall pay to the City of Franklin, or its agent, the following fees:
(1) 
First time fee: $10.
(2) 
Second: $20.
(3) 
Third: $25.
(4) 
Fourth and each occurrence thereafter: $30.
B. 
No dog shall be released until the above fees are paid.
The enforcement of this article shall be the responsibility of the Police Department of the City of Franklin.
