No person shall park or permit the parking of any vehicle in the municipal off-street parking lot bounded on the west by Union Street, on the north by Central Avenue and behind the City Hall complex, except for the purpose of transacting business with the City of Hackensack or a governmental subdivision thereof. No person shall park or permit the parking of any vehicle in the parking lot of the Hackensack Recreation Center (M&M Building), located at 116 Holt Street, between the hours of 12:00 midnight and 6:00 a.m. unless authorized to do so by a special permit issued by the City Manager. This restriction may be temporarily waived in the event of an emergency situation as determined by the City Manager or officer in charge of the Hackensack Police Department.

A. 
R&H Hackensack Urban Renewal, LLC, in its capacity as owner of Block 308.01, Lot 3, commonly and formerly known as City Lot C, has filed a written consent with the City of Hackensack that the Hackensack Police Department have Title 39 jurisdiction over the property.
B. 
The provisions of Subtitle One of Title 39 of the Revised Statutes of New Jersey shall be applicable to the semipublic and/or private roads, streets, driveways, and parking lots located on the property.
C. 
The provisions of Article XIII in this chapter, governing off-street parking areas in the City of Hackensack, shall apply to the property to the extent any such regulations are applicable. There are 200 public parking spaces in the parking deck formerly known as City Lot C ("Parking Deck C") that are available for monthly rental or metered parking at the rates established elsewhere in Article XIII in this chapter, including six handicapped parking spaces, all on a first-come-first-served basis. Monthly permit holders are not guaranteed exclusive use of Parking Deck C at any time, and no parking is permitted in Parking Deck C between the hours of 2:30 a.m. and 5:30 a.m.

The two off-street municipal parking areas, with a total of approximately 20 available spaces, on the west side of Green Street immediately north and south of the intersection at Lodi Street are hereby designated as a monthly commercial parking area and reserved for vehicles displaying New Jersey commercial vehicle license plates. Any vehicle parking in the monthly commercial parking area must be owned or leased by a Hackensack resident. Tenants of the monthly commercial parking area shall be permitted to park their vehicles on a 24-7-365 basis. The City Manager or designee shall have the authority to determine any additional rules and regulations for the use of the monthly commercial parking area, including the monthly parking rate, which shall be initially established at $100 per month, documentation requirements to ensure that the vehicle is owned or leased by a City resident and any limitations on the size, type or weight of commercial vehicles allowed to park in that area.

A. 
Time limits.
(1) 
No person shall park or permit the parking of any vehicle in any municipal off-street parking area in which parking meters are installed for any period of time longer than 12 hours, except in those places where the Police Department shall have posted signs limiting parking to three hours or one hour, whichever shall be indicated on the adjacent meters.
(2) 
No person shall park or permit the parking of a vehicle at a metered space in an off-street lot between the hours of 12:00 midnight and 6:00 a.m., unless authorized to do so by § 170-49B(2) or by a special permit issued by the City Council.

B. 
Manner of parking. No persons shall park or permit the parking of any vehicle in any off-street parking area except in designated spaces with the foremost part of the vehicle nearest to the parking meter, and in any event, all vehicles shall be parked within the lines marked on the pavement measuring such parking spaces.
C. 
Costs. The cost applicable to municipal off-street parking lots in which pay stations or meters are installed shall be $0.25 per 15 minutes ($1 per hour) except for Parking Lot S as described in § 170-45, for which the cost shall be $0.25 per 12 minutes ($1.25 per hour).

D. 
Effective times. The above provisions shall be in effect at all times except Sundays and holidays.
E. 
Additional provisions. All municipal off-street parking lots in which parking meters are installed shall, in addition, be subject to such provisions of Article XII, Parking Meters, of this chapter as are not in conflict with any provisions contained herein.

A. 
Time limit. Except on the streets having posted signs or parking meters limiting parking to a specific number of hours, no person shall park or permit the parking of any vehicle on any municipal street on which parking meters are installed for any period of time greater than 12 consecutive hours.
B. 
Costs. The costs applicable to municipal on-street parking on which meters are installed shall be as set forth in § 170-70, Schedule XXI: Parking Meter Zones.
C. 
Effective times. The costs for on-street meter parking shall be in effect from 9:00 a.m. to 9:00 p.m., daily, except on Sundays and holidays, during which time there will be no charge. Signs shall be posted which shall indicate the effective times.
D. 
Additional provisions. All provisions of Article XII of this chapter not in conflict with § 170-48 shall apply to all on-street meter parking.

A. 
Authority of City Council. The City Council, by ordinance, shall set fees and the collection of fees for monthly parking in the off-street municipal parking lots as designated in § 170-45 entitled "Designation of parking areas."
B. 
Payment. The monthly parking fee shall be paid by the first day of each month for monthly parking in off-street municipal parking lots and parking garages. All fees for monthly parking shall be collected by the City Tax Collector's office. The City Manager is authorized to promulgate such rules and regulations as may be reasonable and necessary for the efficient operation of the municipal monthly parking system.
C. 
Monthly parking fees.

(1) 
Public parking lots. The monthly parking fee for all City of Hackensack public parking lots where monthly parking is available shall be $115 per month.
(2) 
Public parking structures. The monthly parking fee for the Atlantic Street Parking Garage shall be $125 per month. Electric vehicle owners may utilize the EV charging stations up to four times per month at an additional $25 monthly charge. The monthly parking fee for Parking Deck C shall be $135 per month.
(3) 
Parking spaces are available on a first-co]me-first-served basis for both structures and surface lots. Parking spaces are not assigned to a specific tag number or user unless reserved through the Parking Utility.

D. 
Availability. Monthly permit holders shall have the exclusive use of off-street parking lots between the hours of 6:00 a.m. and 2:00 p.m. on weekdays, and shall not be required to pay any additional cost for the use of such lots until 6:00 p.m. on weekdays or to use such lots at any time on Saturday. Hourly transient parking by non-permit holders shall also be permitted in such lots starting at 2:00 p.m. on weekdays and all day on Saturday. A permit does not guarantee that a parking spot will be available.

E. 
Late fees. Late fees shall be assessed as follows:
(1) 
Between five to 10 days: late fee surcharge of 10%.
(2) 
Between 11 and 30 days: late fee surcharge of 20%.
(3) 
Over 30 days: parking is revoked and vehicle is summonsed and/or towed.
F. 
Monthly parking permit. The Police Department shall issue permits, stickers or decals to monthly parkers. Monthly parkers shall park in the designated off-street parking lot or garage associated with the parking permit, sticker or decal. Monthly parkers shall notify the Police Department when they wish to discontinue parking in municipal off-street parking lots. Signs shall be posted indicating monthly parking spaces.
G. 
Enforcement. The Police Department shall enforce the monthly parking regulations.
H. 
Replacement decals. A fee of $15 shall be charged to monthly parkers for all decals which are lost and are replaced by the Police Department.

A. 
No person or persons shall engage in any business of repairing of vehicles while such vehicles are parked or standing upon any municipal parking lot.
B. 
Emergency repairs will be permitted to be made while vehicles are parked or standing upon any municipal parking lot, provided that such repairs are minor, do not interfere with the flow of traffic and must be completed within one hour. In the alternative, the vehicle must be removed from the municipal parking lot. Provisions for such removal of vehicles shall be made by the owner or person in charge of the vehicle or the Police Department.
C. 
In the event that a vehicle is disabled or otherwise unable to proceed on its own power while on any municipal parking lot, the driver or person in charge of such vehicle shall immediately, by the quickest means of communication, notify the Police Department.
D. 
Any vehicle parked or standing in violation of this section shall be deemed a public nuisance and a menace to safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay a reasonable cost of removal and storage which results from such removal before regaining possession of the vehicle.

A. 
Purpose. Pursuant to N.J.S.A. 39:4-197.5, this chapter provides for restricted parking spaces for handicapped persons on public highways and in parking facilities under the jurisdiction of the City of Hackensack.
B. 
Parking spaces; location and construction. Parking spaces for the physically handicapped shall be constructed in accordance with the following guidelines:
(1) 
A maximum of 1% of the total number of parking spaces in the parking facility shall be used for handicapped parking, but these shall be not less than two parking spaces in each such facility.
(2) 
The location of the physically handicapped spaces shall be in an area of the parking facility which is most accessible and approximate to the building or buildings which the facility serves. The determination of said location shall be made by the Chief Construction Official in conjunction and consultation with the Police Department.
(3) 
Each space shall be identified with a clearly visible sign not less than 12 inches by 18 inches, Type R7-8, with the legend "Reserved Parking." Attached to the bottom of this sign shall be a twelve-inch-by-six-inch plate, with black legend on white background, "Division of Motor Vehicle-ID required." The lines designating each stall should be painted blue, and the center of the stall shall have painted the international handicap symbol.

(4) 
Each space shall be 12 feet wide to allow room for persons in wheelchairs or on braces or on crutches to get in or out of either side of the automobile on a level paved surface suitable for wheeling and walking.
(5) 
Where possible, such spaces shall be located so that persons in wheelchairs or using braces or crutches are not compelled to wheel or walk behind parked cars.
(6) 
Where applicable, curb ramps shall be provided to permit handicapped people access from parking area to sidewalk.
C. 
Parking without proper identification prohibited. No person shall park a vehicle in a parking space designated and marked as being set aside for the physically handicapped in any parking facility unless said vehicle shall have affixed thereto an identification certificate or marker issued by the New Jersey Director of the Division of Motor Vehicles. Parking in a handicap space without the aforesaid vehicle identification shall create a rebuttable presumption that use of the space was not for the physically handicapped.
D. 
Penalties. Any person convicted of a violation of a provision of this section shall be liable to a fine and such other sanctions as are authorized by applicable state law.
