The office of Borough Administrator of the Borough
of Haledon is hereby created in accordance with the provisions of
N.J.S.A. 40A:9-136.

The Borough Administrator shall be appointed
by the Mayor with the advice and consent of the Council for a term
of three years.

The selection of the Borough Administrator shall
be made on the basis of executive and administrative ability, training,
experience, and education. The Borough Administrator shall have at
least a bachelor's degree from an accredited college or university.
He/she shall be a resident of the State of New Jersey, a citizen of
the United States, and a person of good moral character and shall
not have been convicted of a crime.
The annual compensation for the Borough Administrator
shall be set in accordance with the annual salary ordinance of the
Borough.
The Borough Administrator shall be the full-time
chief administrative officer of the Borough in the absence of the
Mayor and shall be responsible to the Mayor and governing body of
the municipality. Among the powers and duties for which the Borough
Administrator shall have and be responsible include but are not limited
to the following:
A. Serve as chief administrative officer of the Borough
in the absence of the Mayor, and he/she shall perform such powers
and duties as from time to time are assigned to him by the Mayor and/or
the governing body.
B. He/she shall represent the municipality and assert
its proper interest in relation to federal, state, and other political
subdivisions and with respect to municipal contracts, subcontracts,
interlocal agreements, and other business transactions, except as
restricted by the Mayor and/or the governing body.
C. He/she shall attend all meetings of the governing
body, including regular meetings, work session meetings and special
meetings when directed by the Mayor and may participate in discussions,
but without the right to vote.
D. He/she shall keep the governing body advised of the
financial condition of the municipality, make reports to the governing
body as requested by it and make a comprehensive report on the administration
of the municipal government for the benefit of the governing body
and the public as may be requested by it.
E. He/she shall study the governmental and administrative
operations and needs of the municipal government and prepare and recommend
to the governing body necessary plans and programs to meet its needs
and advise the Mayor and Council on policy decisions.
F. He/she shall supervise the administration of all departments,
including but not limited to the review, recommendation, and implementation
of administrative procedures and policies of the Borough and its departments
in consultation with the respective committee chairman, Mayor and
department heads.
G. He/she shall attend negotiations between the Borough
and employees and employees' representative as shall participate as
authorized by and subject to the approval of the Mayor and the governing
body.
H. He/she shall compile and edit press releases as directed
by the Mayor and/or the governing body.
I. He/she shall assign responsibility for departmental
actions and coordinate operations as authorized by the Mayor and/or
the governing body.
J. He/she shall, in conjunction with the respective department
heads, make recommendations concerning the nature and location of
public improvements and coordinate the execution of the public improvements
authorized by the Mayor and the governing body.
K. He/she shall, in conjunction with the Borough Risk
Manager, supervise and continually review the Borough's insurance
programs.
L. He/she shall recommend to the governing body assignments
and scheduling for all departments and offices. He shall also have
administrative authority over the work of all clerical personnel.
M. He/she shall obtain from each department head, committee,
board, or commission, agency, or officer of the Borough estimates
of revenues, expenditures, and any other supporting data which he
may deem necessary for the preparation of the annual budget.
N. He/she shall, in conjunction with the Borough Treasurer,
establish and enforce the procedure for the purchase of all supplies,
materials, services, and equipment for all departments according to
need and purchasing methods.
O. He/she shall be the chief executive and administrative
official of the Borough of Haledon in the absence of the Mayor and
shall in all matters act under the direction and supervision of the
Mayor and the governing body. He shall, however, in the day-to-day
performance of his duties, comply with any direction to him by the
Mayor.
P. He/she shall ensure that the terms and conditions
in any statute, public utility franchise or other contract to which
the Borough is a party are faithfully kept and performed and, upon
knowledge of any violation, call the same to the attention of the
governing body.
Q. Where, by ordinance, the Borough of Haledon establishes
a department and the Mayor has made no appointment to fill said office
or in the event that the Council does not concur, the Administrator
shall act as head of said department until such time as the Mayor
shall make an appointment to fill such vacancy and until such time
as the Council concurs in the appointment. With the consent of the
Mayor and the governing body, the Administrator may appoint such assistants
in a department where the Administrator acts as department head for
the purpose of the proper operation and control of said department.
R. He/she shall direct and supervise the administration
of all departments of the municipal government and be responsible
for the maintenance of sound personnel policies and administrative
practices under the direction and approval of the governing body.
S. He/she shall not have the power to take disciplinary
action against any employee, except that he shall, where he deems
it to be appropriate, make recommendations to the governing body for
disciplinary action. In any disciplinary action requiring a hearing,
he shall serve as hearing officer and shall make a report and recommendations
to the governing body which alone shall have the authority to take
final disciplinary action, except that where exigent circumstances
exist, the Mayor may suspend an employee until the next regular meeting
of the governing body.

Nothing herein shall prevent the Borough Administrator
from holding another appointed office in the Borough of Haledon, provided
the same is not inconsistent with the duties and obligations herein
set forth. The Borough Administrator may not run for any elected position
within the Borough of Haledon during his/her contractual term.
The Borough Administrator shall not have any
interest, directly or indirectly, in any contract, subcontract, job
for work materials or service or the profit thereof to be furnished
to or performed for the Borough.
During the absence, disability or lack of any
qualified candidate for the position of the Borough Administrator,
the Acting Administrator appointed by resolution of the governing
body shall perform the duties and have the power of the Borough Administrator.
The governing body may by resolution waive the educational qualification
of this chapter in the case of an Acting Administrator who is otherwise
qualified, and such Acting Administrator shall serve only until such
time as the Borough may appoint a qualified permanent Borough Administrator
within the meaning of this chapter.
The Borough Administrator shall not exercise
any powers exclusively vested or imposed by law or ordinance upon
the various elected and appointed officers, boards and commissions
of the Borough.
In the event that the governing body wishes
to remove the Borough Administrator, the procedure by which the governing
body may remove the Borough Administrator shall be in accordance with
N.J.S.A. 40A:9-138 and any amendments thereto.
The Borough Administrator shall be responsible
to maintain and keep a petty cash fund for use of the office of Borough
Administrator and staff. Said petty cash fund shall be used for expenses
reasonably related to Borough business or in furtherance thereof,
and the Borough Administrator shall maintain receipts for expenses
drawn on the petty cash fund. The amount of the petty cash fund shall
be set by resolution of the governing body and shall not exceed the
maximum amount set by resolution without authorization from the Mayor
and/or the governing body.
