A pension shall be paid to the survivors and
minors of any volunteer fire fighter who has died or shall have died
as the result of injury sustained in the course of the performance
of duty as a member of the Haledon Fire Department.
No pension payable under the terms of this Article
VIII shall be less than $20,000 annually.
The pension shall be to the survivors or to
the minors of the deceased fire fighter if the fire fighter leaves
no surviving spouse or to such minor child or children after the death
of such spouse.
No pension shall be payable under the terms of this Article
VIII unless or until the Board of Council shall, by resolution, have determined and certified that the volunteer fire fighter died as the result of injuries sustained in the course of the performance of the duty as a member of the Volunteer Fire Department. The decision of the governing body as to whether the death was in the course of performance of duty shall be final and nonappealable.
The amount of the pension shall not be less
than $20,000 annually, payable in equal monthly installments.
