It is the intent of this chapter to:
A. License and regulate quarries for the protection of persons
and property and for the preservation of the public health, safety and welfare
of the Borough and its inhabitants;
B. Insure that quarrying and related operations shall be
conducted in such a manner as to create a minimum of annoyance from noise
and dust to nearby owners or occupants of property;
C. Provide for the safety of persons, particularly children;
D. Insure that the quarried area shall be suitably and reasonably
rehabilitated after quarrying operations have been completed or otherwise
terminate;
E. Protect the environment by minimizing air pollution,
prevent surface and subsurface water pollution; and
F. Alleviate to the extent practicable the adverse effects
of noise and truck traffic congestion.
As used in this chapter, the following terms shall have the meanings
indicated:
BOROUGH ENGINEER
The Borough Engineer of the Borough of Haledon or his designee.
MAINTENANCE
The repair, upgrade, upkeep, care or reconstruction of equipment
or vehicles on the quarry property. It shall include all types of maintenance
of equipment, except it shall not include the maintenance of office equipment
such as computers, photocopy machines or other equipment used in office work.
"Maintenance" does not include quarrying.
NJDEP
The New Jersey Department of Environmental Protection.
PERSON
Any person, firm, partnership, association, corporation, company
or organization of any kind.
PROCESSED MATERIALS
Rock, ore, stone, sand, slate, shale, or other natural mineral materials
from a quarry or which are recycled.
PROCESS, PROCESSES or PROCESSING
Crushing, grinding, mixing, manufacturing, recycling, screening,
stockpiling, loading and all other procedures necessary to prepare rock, ore,
stone, sand, slate, shale or other natural mineral materials of a quarry for
sale and/or removal from the premises. In addition, processing includes the
preparation, mixture or manufacture of road materials such as asphalt and
other petroleum-based products and concrete and cement-based products.
QUARRY
A place where rock, ore, stone, sand, slate, shale or other natural
mineral resources or processed materials are blasted, excavated, crushed,
washed, graded, recycled or otherwise processed.
QUARRYING
The business of conducting a quarry, including the extraction or
processing of processed materials, the processing of road materials and the
sale or shipping of processed materials or processed materials trucked onto
the quarry. It includes operations such as recycling operations, blacktop
plants, drum plants, batch plants and other similar operations or processes.
It does not include maintenance.
