The purposes of this chapter are:
A.
To guide and regulate the orderly growth and development
of the Borough.
B.
To protect the established character and the social
and economic well-being of both private and public property.
C.
To promote, in the public interest, the utilization
of land for the purpose for which it is most appropriate.
D.
To secure safety from fire, panic and other dangers
and to provide adequate light, air and convenience of access.
E.
To prevent overcrowding of land or buildings and to
avoid undue concentration of population.
F.
To lessen and, where possible, to prevent traffic
congestion on public streets and highways.
G.
To conserve the value of the buildings and to enhance
the value of land throughout the Borough.

As used in this chapter, words in the present tense
include the future; the singular number includes the plural, and the
plural, the singular; the word "lot" includes the word "plot"; the
word "building" includes the word "structure"; the word "structure"
includes all fabricated apparatus; the word "zone" includes the word
"district"; the word "used" shall include "arranged, designed, constructed,
altered, converted, rented, leased or intended to be used"; and the
word "shall" is mandatory and not optional.

Certain words in this chapter are defined, for the
purposes thereof, as follows:
A use customarily incidental to the principal use of a building,
such as the office of a professional man and customary home occupations,
when situated in the same dwelling used by said person as his private
dwelling.
Each of the independent units with separate entrances into
which it is divided by party walls.
The maximum area of a building and its accessories, projected
on a horizontal plane.
A cannabis supplier or cannabis retailer.

A State-regulated cannabis retailer, medical cannabis alternative
treatment center, or clinical registrant, which shall possess prior
to commencing operations one of the classes of permit or permit endorsement
issued by the State of New Jersey that authorizes the dispensation,
sale, or distribution of cannabis or cannabis-derived or infused products
and/or related clinical research, provided that such facility shall
not cultivate, manufacture, process, or wholesale cannabis or cannabis
products from such facility.

A State-regulated cannabis grower, also referred to as a
cannabis cultivation facility; a cannabis processor, also referred
to as a cannabis product manufacturing facility; a medical cannabis
alternative treatment center; or a clinical registrant, all of which
shall possess prior to commencing operations one of the classes of
permit or permit endorsement issued by the State of New Jersey that
authorizes such cannabis establishment to cultivate, manufacture,
process, wholesale, and/or study or research cannabis or cannabis-derived
or infused products, provided that such facility shall not dispense,
sell, or distribute cannabis or cannabis products from such facility.

The permanently established grade of the street in front
of the lot. Where the lot level is higher than the curb level, the
average level of the former, along the wall in question, may be taken
as the base for measuring the height of a side yard, inner court or
outer court. Where a lot fronts upon two or more streets of different
levels, the curb level of the higher street may be taken as the base
for measuring the height of open spaces and buildings to a distance
100 feet back from the street with the higher curb level.
The mean distance from the street line of the lot, measured
in the general direction of the side lines of the lot.
Any building or portion thereof designed or used exclusively
as the residence or sleeping place of one or more persons.
ONE-FAMILY DWELLINGA detached building occupied or intended for occupancy as separate living quarters exclusively for one family or one household with direct access from the outside and further provided with separate cooking, sleeping and bathroom facilities for the exclusive use of the occupants of the unit.
MULTIPLE-FAMILY DWELLINGA structure or building occupied or intended for occupancy as separate living quarters for more than one household with direct access from the outside or through a common hall and further provided with separate cooking, sleeping and bathroom facilities for the exclusive use of the occupants of each unit.
Any number of individuals related by blood, marriage or adoption,
or not more than four persons who are not so related, living together
as a single housekeeping unit, using rooms and housekeeping facilities
in common and having such meals as they may eat at home generally
prepared and eaten together.

An open, unoccupied space on the same lot with a building,
situated between the street wall of the building and the street line
of the lot.
The vertical distance measured, in the case of flat roofs,
from the average finished grade of the four corners of the building
to the highest point of the roof beams, and in the case of pitched
roofs, from the finished grade elevation to the average height of
gable.

An open, unoccupied space on the same lot with a building,
not extending to either the street or the rear yard.
The least of the horizontal dimensions of such court or yard.
The horizontal distance between the end opening on a street
or a rear yard and the end opposite such street or rear yard.
A parcel of land occupied or designed to be occupied by one
building and the accessory buildings or uses customarily incident
to it, including such open spaces as are arranged and designed to
be used in connection with such building.
In all zones containing a minimum width requirement for a
lot, the minimum width shall be required, measured and computed at
both the front line and the rear line of the lot. Both the width at
the front line and the width at the rear line shall comply with the
minimum width requirements for the particular zone. In any case in
which the front line does not intersect the side lines of the lot
at right angles, then the width of such front line shall be computed
as the straight line distance at right angles, or the closest approximation
thereto, with the side lines, or the width of the front line, whichever
is the lesser. In any case in which the rear line does not intersect
the side lines of the lot at right angles, then the width of such
rear line shall be computed as the straight line distance at right
angles, or the closest approximation thereto, with the side lines,
or the width of the rear line, whichever is the lesser.
One that does not conform to the regulations of the zone
in which it is situated.
An open, unoccupied space on the same lot with a building,
extending to either the street or the rear yard.
An area of not less than 180 square feet within the lot available
for the parking of one motor vehicle, exclusive of passageways and
driveways. For parking areas serving retail stores, the minimum width
of the space shall be 10 feet, and the minimum depth shall be 20 feet.
For "parking spaces" serving other uses, the minimum width shall be
nine feet, and the minimum depth shall be 18 feet.

An open, unoccupied space on the same lot with a building,
situated between the rear wall of the building and the rear line of
the lot.
An open, unoccupied space on the same lot with a building,
situated between the building and the side line of the lot and extending
through from the street to the rear yard or, where no rear yard is
required, to the rear line of the lot.
Includes any device, structure or object for visual communication,
so placed or situated on or within a building or premises as to be
visible to the general public without entering upon or in such building
or premises, that is used for the purpose of advertising.
That part of a building between any floor and the floor above
or, in its absence, the ceiling or roof above. A story in which persons
live, sleep, work or congregate, the ceiling of which is more than
three feet above the curb level taken at the center of the street
facade, shall be counted as that fraction of a story which its height
above such curb level bears to the height of a story. A story which
extends less than three feet above such curb level shall not be counted
in determining the number of stories. Any story under a pitched roof
at the top of a building, the floor of which is not more than two
feet below the plate, shall be counted as a half story when not more
than 60% of said floor area is used for rooms, baths or toilets; otherwise,
it shall be counted as that fraction of a story which its floor area
in rooms, baths or toilets bears to the entire floor area.
