As used in this article, the following terms shall have the meanings
indicated:
ALCOHOLIC LIQUOR or MALT BEVERAGE
Any substance whose sale or disposition is regulated by regulations
promulgated by the Department of Treasury, Division of Alcoholic Beverage
Control, within the State of New Jersey.
PUBLIC PROPERTY
Any and all property, including rights-of-way, roads, buildings,
recreational facilities or land located within the Township of Hamilton and
owned by the Township of Hamilton or any other governmental agency.
QUASI-PUBLIC PROPERTY
Any private street, highway, lane, alley or other roadway which is
open to the public or to which the public is invited, and shall in this context
also include any and all parking lots, shopping centers or malls generally
open to the public.
No person shall, on any public or quasi-public property, within the
Township of Hamilton:
A. Consume any intoxicating liquor or malt beverage.
B. Be in possession of any opened or unsealed container
of any alcoholic liquor or malt beverage.
C. Discard any alcoholic liquor or malt beverage containers
upon any public or quasi-public property or upon any private property not
his own without the express permission of the owner.
Any person who shall violate any of the provisions of this article shall,
upon conviction thereof, be subject to a fine not to exceed $500 or incarceration
in the Atlantic County Jail not to exceed 90 days, or both, at the discretion
of the Municipal Court Judge, and each day that the violation under this article
shall continue shall be deemed a separate violation under this article.
