The following fees are hereby fixed and established for certain services extended and materials distributed by the Police Department of the Township of Hamilton, County of Atlantic and State of New Jersey:
A. 
Pursuant to N.J.S.A. 47:1A-1 et seq. (OPRA Law), as amended, the fee for printed copies of Police Department public records shall be as follows:

(1) 
Five cents per letter-size page or smaller.
(2) 
Seven cents per legal-size page or larger.
(3) 
If the Township can demonstrate that the actual cost for duplication exceeds the foregoing rates, the Township shall charge the actual cost of duplicating the record. Actual cost shall be the cost of materials and supplies used to make a copy of the record but shall not include the cost of labor or other overhead expenses associated with making copies except as provided in Subsection C of N.J.S.A. 47:1A-5.
(4) 
Access to electronic records and nonprinted material shall be provided free of any charge except for the actual cost of any needed supplies.
B. 
Search fees in cases where a review of a record is desired: minimum fee of Clerk's hourly salary. Copies of reports or photographs require additional fees.
C. 
Viewing photographs of accident scenes: $3.
D. 
Photographic prints: $10 for each eight-by-ten print.
E. 
Fingerprints of canvassers or solicitors or for employment, immigration or other purposes: $5 per set.
F. 
Audiotapes (dictaphone); copying audiotape for discovery: minimum fee of one hour of dispatch supervisor's hourly salary, plus costs of tape.
The viewing or reviewing of reports and photographs of accident scenes shall be permitted at police headquarters daily, Monday through Friday, from 9:00 a.m. to 4:00 p.m.
No search fee shall be charged in the event that a report or photograph is not on file with the Police Department, nor for any report or photograph for which a formal request is made by any local, county, state or federal law enforcement agency or by the federal postal authorities.

A. 
The Township shall charge the minimum sum of $20 for requests up to 10 pages and the sum of $1 for every page thereafter to any person requesting and lawfully entitled to traffic and/or criminal offense discovery material, which material may be furnished by the State Police to the Township of Hamilton, upon formal request to its Municipal Prosecutor or acting Municipal Prosecutor. Said payment shall be made to the municipality in advance of the discovery material being processed and disseminated.
B. 
Nothing contained herein is to be construed as in derogation of the rights of indigent defendants, whether represented by the Office of the Public Defender or appearing pro se, to obtain discovery material without charge if consistent with applicable statutes, rules of court and/or case precedent.
The Township Clerk shall issue a receipt for all fees and moneys received for the services extended or materials furnished as hereinabove provided. All moneys received shall be deposited within 48 hours of receipt and transmitted to the Township Administrator in the usual manner.
