Except as provided herein, it shall be unlawful
for any person, firm or corporation to produce, sponsor, exhibit or
otherwise present any carnival in the Township of Hanover. For purposes
of this chapter, a carnival shall be deemed to include any carnival,
circus, rodeo, fair or other similar public exhibition.
The Township Committee of the Township of Hanover
may, in its discretion, approve the issuance of a permit to any nonprofit,
charitable, religious, educational or fraternal corporation or organization
where the proceeds therefrom are to be devoted to the purposes of
such organization. Permits may be issued upon application to the Township
Clerk, as hereinafter provided, and approval by the Township Committee
at a regular public meeting of the Township Committee only under the
following circumstances:
A.
The carnival must be held either on the property of
the applicant, in a nonresidential zone of the Township or on property
of the local or regional school district.
B.
The location must be found by the Township Committee
to be suitable from the standpoint of traffic and crowd control and
will not disturb the peace and repose of citizens in the area.
C.
The location, if in a public place such as a shopping
center or other parking area, must be so controlled as not to interfere
with parking and traffic requirements of the usual businesses and
activities conducted on the premises.
D.
No carnival shall be permitted for more than six calendar
days, and no applicant may be granted more than one permit in any
calendar year.
Application for a permit shall be submitted
to the Township Clerk at least 60 days prior to the date set for the
commencement of the proposed event, setting forth:
A.
The proposed number of days and the hours of operation.
B.
The nature of the event or exhibition.
C.
The type and nature of food concessions, if any.
D.
The proposed method of cleanup.
E.
The location, intensity and direction of all outdoor
lighting.
F.
A description of proposed off-street parking, sanitary
facilities, traffic controls and police protection to be available
at the location at which the event is to be conducted.
G.
A general statement as to the purpose for which the
event is to be held.
H.
A list of all of the games, attractions, contests,
exhibits or performances to be included and, if not operated by the
applicant, the name and address of the concessionaire or other person
operating them.
The applicant shall also submit at the time
of application:
Events sponsored by the Township or any of its
departments, and athletic events such as football, basketball, baseball
and softball, shall be exempt from the provisions of this chapter.
In addition to such power and authority as is
conferred upon the Chief of Police by the statutes of the State of
New Jersey and ordinances of the Township of Hanover, in such cases
made and provided, he is authorized to revoke any permit previously
approved if the event, as operated, does not conform to this chapter
and the permit as granted pursuant to the application filed and if
the event, in his opinion, creates or constitutes an imminent danger
to the health and safety of the residents of the Township of Hanover.
Said revocation shall be accomplished by the issuance of a written
order for the immediate cessation and termination of the event.

Any person, firm or corporation convicted of
violating the provisions of this chapter shall be subject to a fine
of not more than $1,000 or to imprisonment for a period of not more
than 90 days, or both, in the discretion of the Judge. Each day that
a violation exists shall be punishable as a separate offense.
