A. 
There is hereby established in the Township of Hanover a State Uniform Construction Code Enforcing Agency, to be known as the "Uniform Construction Code Enforcing Agency of the Township of Hanover," consisting of a Construction Official, Building Subcode Official, Plumbing Subcode Official, Electrical Subcode Official, Fire Protection Subcode Official and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency.
B. 
Each official position created in Subsection A hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217, as amended,[1] and N.J.A.C. 5:23, provided that, in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217, and N.J.A.C. 5:23 to hold each such position.

C. 
The public shall have the right to do business with the enforcing agency at one office location, except for emergencies and unforeseen or unavoidable circumstances.
A. 
There is hereby established a Construction Board of Appeals to hear appeals from decisions by the enforcing agency. Such Board shall consist of five members. At least one Board member shall be a registered architect or licensed professional engineer of building construction experience, and at least one board member shall be as qualified as a Plumbing Subcode Official and one as qualified as an Electrical Subcode Official. No more than two Board members shall be selected from the same business or profession. Each Board member shall have had at least three years' experience in construction, design or supervision as a licensed engineer or registered architect or, in the alternative, five years' experience in construction, design or supervision as an architect or engineer with a bachelor's degree in architecture or engineering, respectively, from an accredited institution of higher education or, as a further alternative, 10 years' experience in construction, design or supervision as a journeyman in a construction trade or as a construction contractor, subcontractor or inspector.
B. 
Members.
(1) 
The Township Committee of the Township of Hanover shall appoint the Board members and any alternate members. For the members first appointed, the Township Committee shall designate the appointees' terms so that one shall be appointed for a term of one year, one for a term of two years, one for a term of three years, and two for terms of four years. At the expiration of such terms and thereafter, appointments shall be made for terms of four years. Vacancies shall be filled for the unexpired term.
(2) 
The Township Committee shall appoint such number of alternates as may be appropriate for terms not to exceed four years or may, in the alternative, appoint alternates on a case-by-case basis.
(3) 
No regular or alternate Board member may be a member of the enforcing agency, the decisions of which are subject to the review of the Board.
C. 
Compensation, if any, for the members of the Construction Board of Appeals shall be set forth in the annual Salary Ordinance for the officers and employees of the Township of Hanover.[1]

A. 
The fee schedule shall be as provided in Chapter 125, Fees, of the Code of the Township of Hanover.

B. 
The Construction Official shall, with the advice of the Subcode Officials, prepare and submit to the Township Committee, biannually, a report recommending a fee schedule based on the operating expenses of the agency and any other expenses of the municipality fairly attributable to the enforcement of the State Uniform Construction Code Act.
C. 
Surcharge fee.
(1) 
In order to provide for the training, certification and technical support programs required by the Uniform Construction Code Act and the regulations,[1] the enforcing agency shall collect, in addition to the fees specified above, a surcharge fee of $0.0006 per cubic foot of volume of new construction. Said surcharge fee shall be remitted to the Bureau of Housing Inspection, Department of Community Affairs, on a quarterly basis for the fiscal quarters ending September 30, December 31, March 31 and June 30, and not later than one month next succeeding the end of the quarter for which it is due. In the fiscal year in which the regulations first become effective, said fee shall be collected and remitted for the third and fourth quarters only.

(2) 
The enforcing agency shall report annually at the end of each fiscal year to the Bureau of Housing Inspection, and not later than July 31, the total amount of the surcharge fee collected in this fiscal year. In the fiscal year in which the regulations first become effective, said report shall be for the third and fourth quarters only.
A. 
The following fire limits are established pursuant to N.J.A.C. 5:23: All Business B Zones as set forth on the map adopted in connection with the Land Use Ordinance of the Township of Hanover.[1]

B. 
The Construction Official shall prepare and submit to the Township Committee, biannually, a report reevaluating the delineation of the fire limits. This report shall indicate the recommendations of the Construction Official, the Building Subcode Official and the Fire Subcode Official regarding those areas which should be designated as within fire limits, with the reasons therefor.

Whenever the Construction Officials determine, pursuant to N.J.A.C. 5:23-6.2, the eligibility of any proposed solar heating and cooling systems pursuant to the standards promulgated in N.J.A.C. 14A:4-1 et seq., any permit and inspection fee as set forth herein shall be waived.

The duties and responsibilities of the Construction Official and the Subcode Officials and all other officials within the Uniform Construction Code Enforcing Agency of the Township of Hanover shall be set forth in Title 5, Chapter 23, of the New Jersey Administrative Code and/or as the same may be amended and supplemented.

The standards and criteria governing the construction and maintenance of all multifamily residential units hereinafter constructed within the Township of Hanover shall comply with the regulations set forth below:
A. 
There shall be between each dwelling unit on the same floor level a partition wall constructed to have a sound-transmission classification (STC) of not less than 50 for airborne noise when tested in accordance with ASTM (American Society for Testing and Materials) recommended practice E-90, listed in Appendix A or as amended.
B. 
There shall be between each dwelling unit on different floor levels or between each dwelling unit and corridors or other public spaces a partition wall constructed to have a sound-transmission classification (STC) of not less than 55 for airborne noise when tested in accordance with ASTM (American Society for Testing and Materials) recommended practice E-90, listed in Appendix A or as amended.
C. 
All exterior walls of each dwelling unit shall be constructed to have a sound-transmission classification (STC) of not less than 39 for airborne noise when tested in accordance with ASTM (American Society for Testing and Materials) recommended practice E-90, listed in Appendix A or as amended.
D. 
No common-party wall located between dwelling units or between any dwelling unit and a garage or between garages shall have a fire rating of less than two hours.
E. 
In addition to the specifications herein, the construction of all dwelling units shall conform to the Building Code of the Township of Hanover and shall generally meet specifications no less than those set forth in Regulations for the Construction and Maintenance of Motels and Multiple Dwellings, promulgated by the Department of Community Affairs of the State of New Jersey and dated July 19, 1968. In those cases where this section, the Building Code and state regulations may contradict, the more stringent specifications shall be required.
F. 
The architecture employed shall be aesthetically in keeping with the surrounding areas and shall be subject to approval by the Planning Board. All buildings shall be constructed in accordance with the Building Code and shall comply with the following requirements:
(1) 
The exterior walls in each group of dwelling units shall be faced with brick, quarried stone, stucco, wood or other materials suitable in terms of quality, durability and appearance. Asbestos shingle and cinder or concrete block as exterior finishes are prohibited. The applicant shall submit to the Planning Board for review and approval, in addition to any and all other documents required by any other ordinance concerning site plan review, floor plans, elevation drawings, color renderings and detailed finish schedules.
(2) 
The exterior of any accessory structures shall harmonize architecturally with and be constructed of materials of a like character to those used in principal structures.
