For purposes of this article, the following terms shall be defined as follows:
INFECTIOUS WASTE
A. 
Equipment, instruments, utensils and fomites of a disposable nature from the rooms of patients who are suspected to have or have been diagnosed as having a communicable disease.
B. 
Laboratory wastes which includes all tissues, specimens, cultures, blood elements, excreta and secretions obtained from patients or laboratory animals, and disposable fomites (any inanimate object that may harbor or transmit pathogenic organisms).
C. 
Surgical operating room pathological specimens and disposable fomites attendant thereto and similar disposable materials from outpatient areas and emergency rooms.
MEDICAL WASTE
All waste generated during the treatment of a patient, both infectious and noninfectious and includes all instruments, supplies, containers, gloves, tubing, bandages, examination paper, disposable gowns, bibs, etc., used by health care practitioners and facilities.
PATHOLOGICAL WASTE
Any gross and/or microscopic biological tissue removed surgically or at autopsy and which meets the definition of solid waste as described under the Resource Conservation and Recovery Act of 1976 (RCRA).

No person shall set or place out for collection any garbage, ashes, refuse or other material other than grass cuttings, leaves and brush along Route No. 10 and Ridgedale Avenue in the Township of Hanover for collection by the Public Works, Buildings and Grounds and Park Maintenance Department of the Township of Hanover or by any private scavenger before 6:00 p.m. on the day prior to the day the refuse is to be collected. All refuse receptacles placed along Route No. 10 and Ridgedale Avenue are to be removed by 12:00 noon on the same day refuse has been collected.

No person shall set or place out for collection any garbage, ashes, refuse or other material other than grass cuttings, leaves and brush along any other streets or public thoroughfares in the Township of Hanover, other than Route No. 10 and Ridgedale Avenue, for collection by the Public Works, Buildings and Grounds and Park Maintenance Department of the Township of Hanover or by any private scavenger before 6:00 p.m. of the day prior to the collection day for garbage, ashes, refuse, etc., for said property. All refuse receptacles placed along any streets within the Township of Hanover, other than Route No. 10 and Ridgedale Avenue, shall be removed by 7:00 p.m. of the same day refuse has been collected.
A. 
Garbage, ashes, refuse and like material shall be placed in strong watertight metal or plastic receptacles equipped with proper handles and tight-fitting covers or plastic bags which are sealed in a satisfactory manner. Such receptacles shall be kept tightly covered and the weight thereof, including the contents, shall not exceed 50 pounds. Garbage shall be drained and shall be wrapped in paper or plastic bags before it is deposited into the receptacles. Garbage receptacles shall be kept in a clean and sanitary condition and placed at the curb for collection.
B. 
All brush and tree limbs must be cut into pieces no more than four feet in length, tied into bundles and placed at the curb for collection.
C. 
No grass clippings, hedge or hedge clippings, shrubbery, shrubbery clippings, tree cuttings or other similar material shall be placed, pushed, raked or swept in or onto any public walk, sidewalk, gutter, road, roadway or public thoroughfare, except that during the months of October and November, leaves and leaves only may be raked or pushed into the gutter in connection with the leaf collection program. For purposes of collection of such items as grass clippings, hedge or hedge clippings, tree cuttings or other similar material, these items shall be bagged or placed in cans or boxes, the total weight of each receptacle shall not exceed 50 pounds and shall be placed at the curb.

No person shall place out for collection by the Public Works, Buildings and Grounds and Park Maintenance Department of the Township of Hanover any pathological or infectious waste as defined in § 154-18 of this article.
A. 
Small generators of medical waste, which include doctor and dentist offices, health-care facilities and veterinary clinics, shall not place out for collection by the Public Works, Buildings and Grounds and Park Maintenance Department of the Township of Hanover any pathological, infectious or medical waste. This waste shall be disposed of by licensed, private scavengers contracted by the generator.

B. 
Small generators of medical waste shall dispose of all infectious or pathological waste in accordance with the procedures set forth in N.J.A.C. 8:43B-3.6, Pathological and Infectious Waste Disposal.
A. 
Residential generators of medical waste shall not place out for collection by the Public Works, Buildings and Grounds and Park Maintenance Department of the Township of Hanover any pathological or infectious waste.

B. 
Residential generators of medical waste may place out for collection by the Public Works, Buildings and Grounds and Park Maintenance Department noninfectious, nonpathological medical waste. Noninfectious, nonpathological waste shall be disposed of on a day-to-day basis to prevent accumulation.

C. 
Solid sharp or rigid items such as needles and syringes shall be sterilized by autoclave, dry clave or other methods approved of by the Township of Hanover Health Department, prior to disposal. Needles and syringes shall be destroyed as stipulated in N.J.S.A. 2A:170-25.17[1] and disposed of in a rigid, puncture resistant sealed container.

D. 
In converting an infectious waste to a noninfectious medical waste, residents must utilize methods which are acceptable to the Township of Hanover Health Department.
E. 
All noninfectious medical waste shall be placed in a heavy-duty plastic bag, tied closed, then placed into a second heavy-duty plastic bag which is tied closed before discarding.
The Police Department and the Health Department of the Township of Hanover are hereby authorized to enforce this article.

The owner or user of any property whereon a violation of this article occurs or any person employed in connection therewith shall each be guilty of a separate misdemeanor and, upon conviction thereof, shall be subject to a fine not exceeding $1,000 and/or imprisonment up to 90 days, or both. Each and every day such a violation occurs shall be deemed a separate and distinct violation. In addition to the fine imposed, violators shall be required to pay any increase in tipping fees or related costs as a result of the inclusion for collection by the Municipal Department of Public Works, Buildings and Grounds and Park Maintenance, items prohibited by this article.
