It is the intention of the Township Committee, the governing body of the Township of Hanover, to adopt an ordinance establishing requirements for the proper collection and disposal of containerized yard waste in the Township of Hanover so as to protect the public health, safety and welfare and to prescribe penalties for the failure to comply.
For the purpose of this article, the following terms, phrases, words and their derivations shall have the meanings stated herein unless their use in the text of this article clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word "shall" is always construed as mandatory and not permissive in nature.
CONTAINERIZED
The placement of yard waste in a strong, watertight plastic or metal receptacle not exceeding 32 gallons equipped with proper handles and tight-fitting covers. Such receptacles shall be tightly covered, and the weight thereof, including the contents, shall not exceed 50 pounds in weight, in order to prevent the yard waste from spilling or blowing out into the street and coming into contact with stormwater.
PERSON
Any individual, corporation, company, partnership, firm, association or political subdivision of this state subject to municipal jurisdiction. This definition includes the owners/contractors of lawn care or landscaping service, including their employees, performing lawn care and maintenance services on behalf of the owner or occupant of any property located within the Township of Hanover.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive or other way which is an existing state, county or municipal roadway, and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas and other areas within the street lines.
YARD WASTE
Grass clippings, hedge or hedge clippings, shrubbery, shrubbery clippings, tree cuttings or other similar vegetative material. This definition does not include leaves.
The owner or occupant of any property, or any employee or contractor of such owner or occupant engaged to provide lawn care or landscaping services, shall not sweep, rake, blow or otherwise place yard waste, unless the yard waste is containerized, in the street. If yard waste that is not containerized is placed in the street, the party responsible for placement of yard waste must remove the yard waste from the street or said party shall be deemed in violation of this article.
The provisions of this article shall be enforced by the Township Police Department and Building Department property maintenance officers.
Any person, firm or corporation convicted of violating the provisions of this article shall be subject to one or more of the following penalties: to a fine not exceeding $1,000; imprisonment up to 90 days; or a period of community service not exceeding 90 days. Each and every day a violation occurs shall be deemed a separate and distinct violation.
